The amendment to the amendment is drawing our attention to Sections 71 and 72 which speak about the right to life and liberty. It is presumed that you can only exercise your right to property when you have your life. Section 70 says:- âWhereas every person in Kenya is entitled to the fundamental rights and freedoms of the individual--- the enjoyment of those rights and freedoms by any individual does not prejudice the rights and freedoms of others or the public interest.â

Mr. Speaker, Sir, therefore, the rights of others must not be trampled on as we seek to restore the sanctity of the title. The public interest must also be looked into. Rift Valley Province is the food basket of this country. The nation is grappling with serious food shortage for the second year running. It is, therefore, important that this matter is disposed of in a manner that everybody will feel satisfied so that we move forward in future.

Mr. Speaker, Sir, the sanctity of title deeds must be respected. However, even as we talk of respecting the sanctity of title deeds, we must also look into the rights of the people not only within the Mau Forest Complex but also in the rest of the country, where we have had people or persons displaced but nothing has been done to ensure that their rights have been taken care of. Many Kenyans have lost their lives in circumstances that are clearly not as envisaged by this Section of the Constitution. We are, therefore, saying that if we are to respect the sanctity of the title deed, we must also incorporate the rights of those who have lost their lives, and those who have a right to life, who were, for one reason or another, deprived of that right. This situation must be extended to other areas, including where we have had the post-election violence. We have other water towers. That is what every Kenyan expects to see.

Mr. Speaker, Sir, the issue of public interest must also be looked into. We are currently using a lot of money to import food. I think an amicable solution to the Mau Forest Complex will ensure that this matter is, indeed, sorted out.

Thank you, Mr. Speaker, Sir. I beg to reply. (a) The road works within Machakos Town, Machakos-Kitui Road is 8 kilometres and Machakos-Kangundo Road is five kilometers. The work had stalled due to exhaustion of funds provided for in the contract. (b) The road works within Machakos Town and Machakos Town Kaseve Market is eight kilometers and it commenced on 15th June, 2009. It is expected to be completed by the end of December, 2009. The work along Machakos-Kangundo Road will be factored in the Budget after the completion of the ongoing detailed design of the entire Kangundo-Machakos -Katumani Road ...

Mr. Speaker, Sir, we appreciate that the condition of the said road is, indeed, deplorable. However, we are in the process of including it in the budget. As I speak, detailed design work has already been commissioned. As soon as that is done, we will be able to avail the funds to do that section.

Mr. Speaker, Sir, when we are issuing the contract to the people who have won it, the contract is very clear; those workers who work in those conditions must be protected. I think it is also the responsibility of the local authorities where some of these works are being carried out, together with my Ministry to ensure that that is done. I want to assure the hon. Member that we have already started a serious campaign to ensure that the members of public who are working on the roads and are exposed to dust and other dangers, are protected.
