have in Article 125. In future considerations of the amendment of the Constitution, we could make Article 125 more effective and effect, what is similar to contempt of the House or contempt of Court in accordance with Article 125. I do support Sen. Osotsi. We need to make further amendments to add more teeth, so that this House can be effective. Consequently, when we summon a governor, he would appear even 15 minutes before the appointed time, for fear of what may happen the moment they appear before the House. I support and recommend that we should be working on ...

Mr. Deputy Speaker, Sir, water is a devolved function. The Ministry of Water, Sanitation and Irrigation directs that the policy and the current Water Act of 2016 was due for amendment. The department of water has been struck by a lot of confrontations with the stakeholders. That is why their regulations never went through. In fact, they ended up in court, and right now, there is a lot of confusion. Regulations come from the Act. Now that the Act is going through amendments and we have just received this Act from National Assembly, which is a devolved function that has ...

In fact, the Constitution has already directed that water services are devolved and the national Government can only give basic principles of the policy on which of these will be implemented. So, when you look at many other failed water projects like the Nol-Turesh water going to Emali, there has been a dispute between Kajiado and Makueni Counties, simply because there are neither proper legal frameworks nor regulations. This results when you make a law like this without stakeholder consultation or public participation. Public participation has become what is in the mind of certain individuals. Public participation should be standard. ...

participation by the Ministry of Water, Sanitation and Irrigation and Council of Governors (CoG). A lot of time the Council of Governors is ignored when a law relating to the counties is being made. This defeats the purpose of why the Senate exists. I have given an example of the Thwake Dam, which has stalled because of mismanagement by people in the National Treasury and Ministry of Water, Irrigation and Sanitation. When you go to the National Treasury, they take you back to the Ministry of Water, Irrigation and Sanitation. When you file the documentation, you will find a civil ...

Thank you, Mr. Temporary Speaker, Sir, for giving me an opportunity to speak on this very important Motion. The last of the worst cases happened to a girl from Makueni County. It was such a sad affair because the girls’ head went missing for some days. She was a university student. You can imagine what it meant for the family and the people who knew her. Her parents were struggling to look for their daughter’s head so that they could have a decent funeral. Although the funeral ended up being a private affair, this matter was in the news for ...

it, and use this House to lobby against such violence as we make our relevant debates so that there can be sensitisation into the country that such a thing is bad. The law should take action against those caught so that in future no one repeats it and our children can stay safe. I thank you.

Thank you, Mr. Speaker, Sir, for giving me an opportunity to contribute to this important Motion. The SBC is the engine of the House. Most of the planning and efficiency of the House will highly depend on it. It is a very well-balanced list and I support it. Mr. Speaker, Sir, having been in the National Assembly for 10 years, I confirm what Sen. Mungatana said. All the laws related to devolution must either originate here, while some which touch on finance originate from the National Assembly. I have sat in the Mediation Committee many times and some would be ...
