Mr. Temporary Deputy Speaker, Sir, I want to start by thanking all the hon. Members for their very valuable contribution. Most of the hon. Members who spoke made extremely valuable contributions on how to strengthen this law. The first proposal was that we should have a mechanism for enforcing what the proposed law is advocating, and that is non-discrimination on basis of race or ethnicity and promoting cohesion. The Bill seeks to establish a Truth, Justice and Reconciliation Commission as a body corporate that will be charged with the responsibility of promoting peace, justice and national unity; healing and reconciliation among the people of Kenya. The Bill is borne out of the realisation that lasting peace and co-existence cannot prevail in Kenya unless historical injustices and violations and abuse of human rights have been addressed. Mr. Deputy Speaker, Sir, I rise to support this Vote and to tell the Minister and the House that if there is one Government Ministry or area that urgently needs very serious reforms, it is the July 22, 2008 PARLIAMENTARY DEBATES 1999 Ministry of Lands. I am glad that it has a Minister and Permanent Secretary who are well- versed in reforms. Mr. Speaker, Sir, I rise to issue a Ministerial Statement in response to Mr. Imanyara's request of 9th July, 2008, for the Leader of Government Business to inform the august House about the constitutional implications of the simultaneous absence of the President, the Vice-President and the Prime Minister from the country. Mr. Speaker, Sir, I have already stated the express provisions - not imagined provisions - of the Constitution. I think what is being envisioned here is what are the desirable amendments, or inclusions, that we should insert during the Constitution review process and a Bill is pending before this House for the comprehensive review. We shall be grateful for all those views when the time comes. But at the present, the Constitutional provisions for all those eventualities are as clear as day light.

The objects of this Bill is to provide for the establishment, powers and functions of the National Ethnic and Race Relations Commission, and for connected purposes. Mr. Temporary Deputy Speaker, Sir, the Commission--- I beg your pardon, Madam Temporary Deputy Speaker. I had not noticed the change of the Chair. I was contemplating on the Bill. Madam Temporary Deputy Speaker, the rest of the staff of the Commission, including the Secretary to the Commission, will be hired by the Commission itself. The procedures are indicated in this Act. Clause 11 also provides for the removal from office of members of the Commission. That is a standard procedure. On a point of order, Madam Temporary Deputy Speaker. The Member on the Floor has just claimed that elections were stolen by the Electoral Commission of Kenya. Could he substantiate or withdraw that remark? We do not know of any stolen election. Elections are won. If he stole his, 1514 PARLIAMENTARY DEBATES July 1, 2008 elections were won by others!
