Mr. Temporary Speaker, Sir, thank you for giving me the opportunity to comment on the Motion and to support the Report of the Mediation Committee on the Political Parties (Amendment) Bill. Before I get to the details of this particular Motion and the Report of the Mediation Committee, allow me to pass my condolences to the family, friends and the nation on the sad demise of Mama Lucy Kibaki who was the third First Lady of this country. Nowadays, there are some characters who operate from the belly of the State House bearing titles like Presidential Communication Unit but what ...

Mr. Temporary Speaker, Sir, there are those that will not meet the threshold but they are very serious. However, there are also a few that will not meet the threshold and we could call them jokers. I can give you an example. Article 91 of the Constitution is about basic requirements for political parties. They are listed from (a) to (h) and that is about eight distinct requirements. If you apply that benchmark to political parties in this country, you might find some that do not live up to the expectations of the Constitution. So, those that do not qualify ...

On a point of order, Mr. Temporary Speaker, Sir. Sen. Hassan who is my senior in many ways comes from Mombasa where they are very articulate in Swahili. He would be familiar with the Swahili proverb which, if I translate, says, good things sell themselves and bad things explain themselves. Mr. Temporary Speaker, Sir, not at all. For the record, I admire the democratic process within the Wiper Democratic Party. I will give you examples of parties which I should be proven wrong. There are parties in this country that get money out of this fund. However, when you look back, even those relatives of ours who are members of those parties will not tell you when they were ever called for elections. The point is, if we are providing some threshold for eligibility to the Political Parties Fund, part of it should be that these parties must be able ...

Thank you, Mr. Temporary Speaker, Sir. If you look at the objectives of the fund, part of it is to promote representation of minorities. Today, we know that there is a debate on how we will promote the representation of women. We must ask ourselves how much parties have used these funds to promote the representation of the minorities like women, youth and persons with disability. Another point is that parties can use these funds to conduct campaigns and party nominations. However, remember the role of regulating and conducting party nominations lies with the Independent Electoral and Boundaries Commission (IEBC). ...

Mr. Temporary Speaker, Sir, I am perfectly in order because Cabinet Secretaries (CSs) were involved in campaigns. The IEBC itself named a particular Cabinet Secretary (CS) who was involved in campaigns, contrary to the electoral code of conduct. The point is; the activity and health of political parties is not just tied to the Registrar of Political Parties but to IEBC as well. That is why we are calling for disbandment of the IEBC. As per the Constitution, it has failed to promote most of the objectives.

Mr. Temporary Speaker, Sir, I support this Motion. I also congratulate the Members who represented this House in mediation. The issue of mediation is a constitutional matter. Sometimes, I observe that when Bills originate from the National Assembly, and to the Senate, there are instances in which Senators are hesitant to make significant amendments that will put us in a position that we have to mediate. One of the examples is the matter of the Division of Revenue. I recall that last year, there were issues when the Senators made proposals that went beyond what the National Assembly thought that ...

Thank you, Sen. Wako, because the next thing was the Chair to ask me to substantiate. Sen. Wako, I want to assure you that when and not if you run for that position, you will have my vote. That tells you something about the depth and breadth that sits in this House. I encourage my colleagues that even as we look at the issue of division of revenue which I know is still in our Order Paper, let us not be shy to propose amendments. Sometimes when we sit with our brothers and sisters in the National Assembly, we joke ...
