  • 22 Oct 2008 in National Assembly: Madam Temporary Deputy Speaker, I have stated that there is a valid argument in what the hon. Member is saying. However, I have also said that the Public Procurement and Disposal Act, 2005, that was passed by this House, indeed, has some flaws and it will be necessary for us to review the clauses in that particular Act in order to facilitate an element of broader participation at the level of local authorities.   • 22 Oct 2008 in National Assembly: Madam Temporary Deputy Speaker, first and foremost, the law is as it is now, is markedly unfair. I have, in the meantime, instructed that all processes and procedures must also be made available to the relevant committees of the council. It could be the Finance Committee or the ones involved in overseeing projects or programmes. This must be done and I have instructed the local authorities to do so. However, the right thing that must be done is to strictly amend the Public Procurement and Disposal Act and allow for the inclusion of these leaders in the tender committees. view

(b) The Municipal Council of Kisumu has not been granted a charter for city status because October 21, 2008 PARLIAMENTARY DEBATES 2833 the formalisation of its current status is not yet complete. (c) My Ministry is in the process of amending the Local Government Act to formalise the upgrading of the Municipal Council of Kisumu to a city. view
  • 21 Oct 2008 in National Assembly: Mr. Speaker, Sir, it is the Ministry of Local Government that ought to formalise those pronouncements. It is true that on 15th December, 2001, Kisumu was declared a city. It was followed by Mombasa on 1st January, 2002. As I said earlier, the law does not provide for granting of city status to municipal councils in Kenya. We are going to make amendments to facilitate that. view
