That, be as it may, Mr. Speaker, Sir, the point that is clear is that the County Council of Mara was not able to be constituted earlier because, if we recollect, we had only eight councillors who were elected in the actual General Elections. Then, there were chaos in that constituency. In those chaos, a lot of ballot papers and other things were messed up. There was no clear election for the others. Therefore, we could not have constituted a council of 22 councillors using only eight councillors, when the bulk of the councillors had not been elected because of ...

Mr. Deputy Speaker, Sir, I stand to support this Bill and commend all those who have participated in enabling it to come before this House in this format. I think this is a very innovative process because under normal circumstances, the current Constitution that we have would have called for the appointment of a tribunal to look at the conduct of the various commissioners. Madam Temporary Deputy Speaker, let me once again apologise for not having been here when the Question was asked the first time. However, I beg to reply. Madam Temporary Deputy Speaker, I have stated that there is a valid argument in what the hon. Member is saying. However, I have also said that the Public Procurement and Disposal Act, 2005, that was passed by this House, indeed, has some flaws and it will be necessary for us to review the clauses in that particular Act in order to facilitate an element of broader participation at the level of local authorities. I agree that it is wrong to completely lock October 22, 2008 PARLIAMENTARY DEBATES 2893 out the local representatives from those committees.

Madam Temporary Deputy Speaker, first and foremost, the law is as it is now, is markedly unfair. I have, in the meantime, instructed that all processes and procedures must also be made available to the relevant committees of the council. It could be the Finance Committee or the ones involved in overseeing projects or programmes. This must be done and I have instructed the local authorities to do so. However, the right thing that must be done is to strictly amend the Public Procurement and Disposal Act and allow for the inclusion of these leaders in the tender committees.
