On the amendment by hon. John Mbadi, Member for Suba on New Clause 21(a), my Committee declined this amendment on the basis that the amendment to Pay As You Earn (PAYE) tax structure would negatively affect income tax collections. Indeed, the amendments by our hon. colleague do very validly contravene the basic tax principles of equity and non-discrimination and will deny massive revenues to the Exchequer. It is, therefore, the case that the Committee has declined but we are warm to the idea of spending more time and more consultations, particularly with stakeholders on this particular idea in due course.

Hon. Speaker, on the amendment by hon. John Mbadi again on New Clause 22(a), my Committee again declined the amendment due to the expected impact on the capital markets and the need to seek wider consultations. Indeed, as I was sitting in this Chamber, I got a call from the National Stock Exchange (NSE). They are very worried about these amendments and we could easily affect the NSE very negatively thereby engineering inflation and rising the cost of standards of living of our people. On the amendment by hon. George Mallan Omondi to Clause 15 of the Finance Bill, 2013, my Committee again opposed the amendment to Clause 15(3) which seeks to delete the words “and 30 per cent of the tax in dispute.” However, my Committee proposed that Clause 15 of the Finance Bill, 2013 may be amended to provide that the payment of the 30 per cent of the tax in dispute should be limited to a period of 90 days. Hon. Speaker, I just wanted to, perhaps, mention for the comfort of my good friend, hon. John Mbadi, that we discussed this matter in the Budget and Appropriations Committee well ahead of time. We were aware that there were timelines by which the report needed to be before this House. We discussed this matter and instructed the Parliamentary Budget Office to ask the National Treasury to be seized of the matter and report appropriately in good time. I thank you, hon. Speaker.

Thank you, hon. Deputy Speaker. I thank you for giving me this opportunity. I beg to second. It is important that we move with speed to pass the County Allocation of Revenue Bill. Hon. Deputy Speaker, you will note that July has already passed; that is the first month of this financial year and the counties are yet to receive their money. We do not wish to stand in the way of the counties receiving the money. amendments have huge implications and we are being asked to suggest or rather accepting that monies can move from the Exchequer to the counties every month. That is outside the established protocol provided for in the Act that I have mentioned. We have given this matter some thought and we will be coming back to suggest that we tame some of the provisions that are proposed by the Senate.

Hon. Deputy Speaker, as I conclude, it is also important that we realise that we have done our job. We need to pass this Bill today so that, as I said, the money can go to the counties.
