Mr. Temporary Chairperson, Sir, I move that we delete this proposed amendment, unless, of course, the Chairman states specifically what sort of clearance is being sought for. I have explained it. Clause 25 states that the Kenya Revenue Authority (KRA) gives a compliance certificate. There is no such process with the EACC.

Thank you, Mr. Temporary Speaker, Sir. I beg to move that the County Outdoor Advertising Control Bill (Senate Bill No. 11 of 2015) be read a Second Time. Let me confirm that the Committee on Information, Communication and Technology (ICT) in which I am the Vice Chairperson, has allowed me to sponsor this Bill. At the first instance, there was concern that this Bill was not supposed to be in the Senate. All those fears were allayed by Hon. Justice Lady Mumbi in her judgement which she passed last year on a matter concerning roads. She said that this Bill ...

Thank you, Mr. Speaker, Sir. Sen. Sang and I have worked very well in the Committee on Legal Affairs and Human Rights – not hustling like Sen. Wangari said - and I would like to congratulate him. Now that Sen. Sang has been raising very interesting points of order where you have to make rulings, I am waiting to see how he will react to similar points of order particularly from this side.

Mr. Speaker, Sir, now that I am on my feet, I thought this would be a tremendous opportunity for us to set precedence. Every time somebody raises an issue, we quote previous rulings either by yourself, Speaker Kaparo or any other Speaker. However, we do not have documented rulings of what you have said previously. I remember an instance where there was a quarrel as to whether you ruled one way or the other about the Constitution. Would I be in order to suggest that you set precedent as the first Speaker who has caused for the rulings to be ...

.: Mr. Speaker, Sir, allow me to say that what we have been called for is not urgent. Let me tell you what is urgent. You were reported in the news yesterday that three Bills from this Senate have been rejected by the National Assembly and you have threatened to go to court. A Bill concerning the Constituencies Development Fund (CDF) has been signed without the Senate. That is urgent. What we have been called here for is not urgent. The electronic version of the Senate Hansard Report is for information purposes only. A certified version of this Report can ...

Mr. Temporary Chairman, Sir, I oppose this amendment. I will quote Article 249(2) of the Constitution; “The commissions and the holders of independent offices— (a) are subject only to this Constitution and the law; and (b) are independent and not subject to direction or control by any person or authority.” Mr. Temporary Chairman, Sir, to subject the office of the Auditor-General which under Article 229 is an independent office to the PSC is unconstitutional and the President must be told so. In addition, Article 234(5) which is referred to, of functions and powers of the PSC, there is no clause ...

Mr. Deputy Speaker, Sir, this is a sad day for this country and the Constitution. Fortunately, no Government is in power forever and neither are bad manners. There are six clauses that we have made. All of them are unconstitutional. However, that is not my point. We, as a Senate, have allowed ourselves to be used. We have allowed ourselves to be used to rubberstamp decisions that are not constitutional. Our Bills have been rejected at the National Assembly. The CDF law has been passed without our input. We have been forwarded documents from the National Assembly and we have ...
