  • 26 Nov 2014 in Senate: Mr. Speaker, Sir, in support of what my fellow Senators have said, I just want to suggest to my senior, Sen. Musila that under Article 125 of the Constitution, the Senate has got powers to call the attendance of witnesses, summon for evidence, call for production of documents and issue any commission to any person. Therefore, the fact that there is a gag order against governors does not stop the Senate from calling for evidence from any other person. The Senate should not look as if we have been rendered impotent by virtue of that court order. view

From a reading of this letter, I recall that we have a famous saying that goes: “He who represents himself has a fool for a client.” Sen. Hassan Omar is a good lawyer. Pursuant to your Communication, I am wondering whether our intention to go to the Supreme Court has now been overtaken by events. Secondly, in my own reading, the fact that, that Bill is now at the Senate, we have cured the obvious problem that was there. The Government is solely responsible. No Member of the Opposition sits in any security committee or gives any command to any person in the security organ. Kajwang, I wish to pass my condolences to his family and his constituents and people who liked him and many others who most likely, in his life, did not like his comments but are now celebrating him. Mr. Temporary Speaker, Sir, standing here today, I know the pain that the family is going through, having lost my father just about a year ago in similar circumstances. Yesterday he made a very robust constitution and what the drafters intended particularly when it came to the Administration Police or the police generally. (Prof.) Lonyangapuo has done it very intelligently. It is a very well crafted Amendment Bill so that it complies. Somebody is whispering to me that he is a very intelligent professor and I agree. Mr. Speaker, Sir, I do not wish to repeat what the Senate Majority Leader and Senate Minority Leader have said. Out of the questions that we will present to the Supreme Court, the answer to the question as to the constitutional status of the Acts of Parliament which have been passed without your concurrence is that the Acts of Parliament are unconstitutional.
