  • 11 Nov 2015 in National Assembly: Ni kweli kama vile Hoja inavyosema kwamba wengi ambao wataenda kwa hospitali hizo kuhudumiwa kwa mara ya kwanza wanapata watu ambao sio wataalamu katika taaluma hiyo. Ikiwa mtu amekuwa mgonjwa, kwa mfano, amepata ajali na afike apate mtu ambaye si mtaalamu kwa suala fulani, ni rahisi kwa mtu huyu kupoteza maisha yake. Ndio maana ningependa kuunga mkono kwamba kuna haja kweli ya kuhakikisha ya kwamba mafunzo maalumu ya afya ya watu wetu itafanyika hasa kwa madaktari na hata watu wengine ambao wanaweza kutusaidia kwa mambo kama hayo. Mambo haya yakifanyika, naamini yatasaidia watu wetu na tutaokoa maisha ya binadamu. view

  • 11 Nov 2015 in National Assembly: Yes, Hon. Temporary Deputy Chairman. I would like to support the Committee’s amendments. The figures that were initially in the Bill were too low. Considering the fact that this Parliament discussed the Small Claims Courts Bill, we now have to take these figures of Kshs10 million to Kshs15 million to the Magistrates’ Courts. Most stations in this country are manned by Resident Magistrates’ Courts. We require these good figures in terms of pecuniary jurisdiction so that parties can easily access justice. I support. view

Temporary Deputy Speaker, Kenyans passed a new Constitution and with the three arms of the Government in place; that is the Judiciary, Legislature and Executive, there are certain constitutional principles that need to be adhered to. So, if you look at this Bill, you will find that one very interesting feature that comes out is the question of consultation.   • 15 Oct 2015 in National Assembly: As has been observed by my fellow colleagues, there was a time when judgement would be passed and one would question whether those judgements are considered as they are supposed to be. I believe with this particular law and the other laws that we have endeavoured to discuss and pass within these Chambers, the question of independence of Judiciary will now not be an issue for anybody to complain. view

Jurisprudence is a very important aspect in the development of the law. You will realise that even today, we still have our judges quoting case laws decided long time ago. Occasionally, they refer to Lord Denning and the likes. So, we wonder whether our judges now are really participating in the formulation of the law. The other issue that I wish to address is the question of public policy. In this Bill you will realise that before judgement is passed, it is important that the judge has the realities of political, social and economic way of life of the people of Kenya.   • 15 Oct 2015 in National Assembly: The other issue that I wish to point out here is the element of devolution in this Bill. Under Clause 6 of this Bill, the Chief Justice for the purposes of accessibility is allowed to put up sessions where this Court of Appeal will be sitting. If, for instance, you have these stations in almost all parts of the country, then accessibility to judicial services of that matter will not be a complicated issue and we will be moving forward. view
