On a point of order, Mr. Deputy Speaker, Sir. As much as you say that we throw this report on our performance in this House into the dustbin, I want to tell you that, that is not a decision of the public court. Why can this House not, through you, take some measures like taking this organisation to court on behalf of Parliament instead of dismissing this report by urging us to drop it into the dustbin when the people of Matungu are already judging a very hard working Assistant Minister like hon. David Were?

Mr. Deputy Speaker, Sir, I beg to reply. (a) During the visit by the Minister for Water and Irrigation to Nyando District on Saturday, 17th January, 2004, the Minister promised to donate 10 motorised pumps to deserving irrigation groups in the district in order to enhance their irrigation production. The pumps were to benefit groups in three constituencies of Nyando District as follows: Nyakach, 4; Nyando, 3; Muhoroni, 3. Groups to benefit have already been identified and they fall into two categories, namely, women and youth groups. Funds to purchase the pumps were not available in the last financial year ...

Mr. Deputy Speaker, Sir, first of all, the hon. Member has confirmed that actually the money is in the Budget. It is just the procurement procedures that we are undertaking and we cannot put a date. But I want to assure the hon. Member that this is a Government that November 1, 206 PARLIAMENTARY DEBATES 3327 keeps its promises. Therefore, before the end of this financial year, we will have delivered the pumps.

Mr. Deputy Speaker, Sir, the problem with some of our Opposition Members is that they value ODM-K rallies more than development programmes. I visited hon. Khamisi's Bahari Constituency and we gave him Kshs10 million to build a resevior tank this financial year. Shame on him!

Mr. Deputy Speaker, Sir, maybe I said it with a loud voice because I was a bit incensed by the hon. Member. I went to his constituency and I was accompanied by two Ministers who are hon. Dzoro and hon. Kingi who are all here. However, here is a Backbencher who decides to go and attend an Orange Democratic Movement (ODM) rally instead of attending to serious business in his constituency. This was evidenced by their party leader the other day when he said that their work is to politick!

(a) I am aware that Mr. Dismus Omwenga Ogache, who was employed as a subordinate staff in my Ministry was reported missing from his work station in Mandera on 27th June, 1992. (b) The Kenya Police opened an inquiry file immediately the matter was reported and investigations commenced on 30th June, 1992. The District Commissioner, Mandera and the entire 3236 PARLIAMENTARY DEBATES October 31, 2006 Government authorities in the district embarked on the search, tracing and investigations into the whereabouts of Mr. Omwenga but all the efforts were fruitless. Mr. Speaker, Sir, according to the law, one can only be presumed dead after seven years. That is exactly what the PS in my Ministry advised Mr. Omenga's family. Mr. Speaker, Sir, the next of kin Mrs. Alice Okenyori Peter who is Mr. Omwenga's wife was issued with a court order on 30th August, 2005 presuming her husband officially dead. She went to our Ministry and she was advised that after getting the death certificate she should get the documents from court. She got the documents by 5th April, 2006.

Mr. Speaker, Sir, the late Mr. Omwenga was only a subordinate staff and it is only the National Social Security Fund (NSSF) that can calculate his dues. That is what my Ministry wrote in the letter dated 5th April, 2006 and we believe that they received this letter, advising them to go to the NSSF to get their benefits.

Mr. Speaker, Sir, I have been very clear that, it is the Ministry which advised the family of Mr. Omwenga on how to go about it and get the death certificate. We have also been very clear that since Mr. Omwenga was only a subordinate staff, according to the regulations, he qualifies for survivors' benefits only, payable by the NSSF. We also advised the family on the same.
