Mr. Temporary Deputy Chairman, Sir, as I am giving this point of information, let me encourage hon. Members to read the Sexual Offences Act. It is something that is important. If we do not know what is in it, that is a bit dangerous. Indecent act is defined in the interpretation section. Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, the provisions relating to the Sexual Offences Act be amended by inserting the following new amendments in proper numerical sequence:- Delete Paragraph 3 and substitute therefor the following new paragraph- 3. Any proceedings commenced under any written law or part thereof repealed by this Act shall continue to their logical conclusion under those written laws. We want it to do its work but we do not want to create a monster. I think that the Committee on Administration of Justice and Legal Affairs should be commended for looking at all the 41 laws and being able to present proper amendments.

Mr. Temporary Deputy Speaker, Sir, I have listened to the Mover very carefully and I think he has a point in terms of the principle of the need to interrogate employment in the Public Service. Listening to him, I would have preferred that we do a proper audit, so that we can look at it from a point of view of a whole institution. For example, in a particular Ministry, how many people have been employed from each region? For example, if 700 people have been employed in a Ministry, out of those 700 people, then what are the regional ...

Yes, that is true! So, when you are going to say that Njoki has been appointed, she has been appointed as who? We need to move away from ethnicity and move much more to merit. The younger Kenyans do not want to hear this word "ethnicity". That is a thing that belongs only in this House and to the older generation. We need to move away from it. Mr. Temporary Deputy Chairman, Sir, I stand here to support the amendment. I think Parliament must recast itself back to 2003 when we passed this Act. At that time, there was an Attorney-General. There was also the Minister for Justice and Constitutional Affairs. We decided, here in Parliament, to create this statutory body and put it under the Office of the Attorney-General. This statutory body reports to Parliament once a year. In the Departmental Committee of the Administration of Justice and Legal Affairs, we have an oversight role to play over the KNCHR. If you look at the amendments coming from the Departmental Committee on Administration of Justice and Legal Affairs, we have amendments starting at Section 4. The Attorney-General has no amendments to Sections--- He has just moved amendments to Sections 23 and 56, which are also proposed for deletion September 12, 2007 PARLIAMENTARY DEBATES 3889 by the Departmental Committee on Administration of Justice and Legal Affairs. As I do so, I would September 12, 2007 PARLIAMENTARY DEBATES 3897 like to inform hon. Members that the Committee did have discussions with the Kenya Anti- Corruption Commission.
