asked the Minister for Lands:- (a) what qualifies a district to have a land tribunal and what the membership of such a tribunal is; (b) why he has not constituted a District Land Tribunal in Tana River; and, (c) when the Ministry will constitute and gazette the tribunal in the district.

Mr. Speaker, Sir, I had an opportunity to go through the gazette notice. It will not be lost to you that Tana River as a district is concealed within the names of another district. That is how the gazette was printed. Since the gazette notice has not adequate circulation even in Tana River, how else do you notify people who have been gazetted that they ought to serve in a tribunal and adjudicate on disputes?

Mr. Speaker, Sir, my question has not been answered by the Assistant Minister. You have gazetted those names but, as I know, the people in Tana River District do not even know that they have been gazzetted to serve in that tribunal. We have several cases which have adjudicated in a court and referred to a tribunal. But because the people are not aware of any tribunal, we have nowhere to refer those cases to. So, apart from the gazettement, how are you able to communicate to the members that they have been duly nominated to serve in a tribunal?

Thank you, Mr. Speaker. I stand guided. Is the Assistant Minister in order to say that it is the District Commissioner who will give the appointment letters? Those people are not appointed by the District Commissioner. They are appointed by the Ministry. Is he in order to insinuate that it is the District Commissioner who is supposed to appoint them?

asked the Minister for Water and Irrigation:- (a) when the tender for the sinking of the borehole at Tula in Bangale Location was advertised; (b) when and to whom the contract was awarded and whether she could provide a copy of the contract documents; and, (c) to indicate the status of the borehole and whether she is aware that the contractor abandoned the works before completion around August 2010.

Mr. Speaker, I was just trying to go through the documentation that the Minister has given me and the contract sheet that was signed; although on the front page indicates Tula, at the annex, it seems to have been omitted. I think this is one thing that she can correct. However, in the geo-survey report that was submitted to the contractor by the Ministry, some paragraphs indicate that some deposits are expected. Below the recent deposits, various strata of clay, silt, sand and other sedimentary beds are expected. I do not think that this was a shock to the contractor ...

I stand guided, Mr. Speaker, Sir. In December, the Minister promised that the borehole in Bangale would also be completed. However, it has also been abandoned midway. Could she tell this House, and Kenyans, when the contractor will be on site to complete this borehole?

Mr. Speaker, Sir, this Ministry spends a lot of money on compensation. Now that we happen to be thinking of reviewing the Wildlife Act, they might even be entangled in spending more money. It is not only in those dams where we have problems. Even along River Tana in Tana River District, there are hotspots where people cannot go and get water. Can I ask the Ministry to be diverting certain amounts of money to development of the watering points, so that members of the public do not seek compensation, but are enabled to get water without crocodiles striking him?
