Mr. Temporary Deputy Speaker, Sir, you know the Assistant Minister kept on lamenting that the Ministry of Finance and the Departmental Committee on Health have been unable to budge to the demands. I am currently aware of budget lines where about 50 hospitals are under renovation by donors and Government counterpart funding. Could the Assistant Minister tell the House what criteria they have used in selecting those hospitals and why this particular hospital has not been considered?

Mr. Speaker, Sir, the Question that required the Minister’s visit is slated for tomorrow and although this is on the same Bura Irrigation Scheme issue, it is on a different aspect of land that was not tilled. I also wanted to put it on record that one Question from the same Ministry was deferred last week. Yesterday, again, the same Ministry had to defer my Question which was by Private Notice that has been on the Order Paper for the last three weeks just because the Minister alleges she was unable to get a sufficient answer. Mr. Speaker, Sir, I was restraining myself from rising on a point of order but a time has come when the statement by the Prime Minister has warranted my doing so. Is he in order to mislead the House by saying that the Provincial Administration will be absorbed into the county governments when the Presidential Memorandum that challenged some of the amendments to the County Government Act stipulated that the Provincial Administration would be serving the National Government at the local level, and that he would not accept it to be part of the county government?

On a point of order, Mr. Temporary Deputy Speaker, Sir. The Minister, although he has said that the matter is in court and the Chair having ruled that he cannot answer questions pertaining to the details because it would be sub judice, I thought it would be prudent for him to table the documents, first, for us and you as the Chair to ascertain before you rule on whether he can go to the depth of the matter.

Bw. Naibu Spika wa Muda, hili ni Swali la dharura na lilikuwa katika ratiba wiki tatu zilizopita. Hii ni mara ya tatu kwa Swali hili kuahirishwa. Waziri Msaidizi akisema kwamba atajibu Swali hili siku ya Alhamisi, anajua ya kwamba Wizara yake inafaa kujibu Swali lingine la dharura Alhamisi hiyo? Ningeuliza Waziri Msaidizi - sidhani kama yuko mafichoni - ajaribu kutafuta jibu kama inawezekana kabla ya Maswali ya siku ya leo kujibiwa yote.

Mr. Temporary Deputy Speaker, Sir, when we were moving a Motion here asking for the deployment of the Kenya Defence Forces to the Tana Delta, we made very clear the fears that we had back in our minds that there could be atrocities committed. That is why the Government, despite our plea, deployed the GSU and the regular police in large numbers. It is unfortunate that the police and the GSU are not pursuing the real culprits and that they are now mistreating the elders, women and the innocent are suffering. Mr. Temporary Deputy Speaker, Sir, although you denied me a chance to raise a point of order on the Statement sought but now, even the Order has not been called out. So, even though you have asked whether the Chairman of the Departmental Committee is ready so that we can dispose of this matter shortly, we should have the Order called out first before we can proceed.
