Hon. Temporary Deputy Speaker, the Committee, having considered the Curriculum Vitae of the nominees and having heard their oral submission during the vetting exercise at the sitting held on Wednesday, 28th November 2018, the following observations were made: (i) The nominees met the qualification requirements of the Public Service Commission Act No.10 of 2017. (iii) The nomination comprised of five persons of female gender and three male genders and, therefore, that meets the constitutional requirements of gender equity. None of the nominees has at any time, within the proceeding five years vied, held office or stood as a MP, Members of a County Assembly (MCA) or a Member of a governing body of a political party.

Hon. Temporary Deputy Speaker, the Committee took cognisance of Article 250(4) of the Constitution on composition and appointment of commissions and independent offices which provides the national values under Article 10 and the principle, the composition of commissions and offices, taken as a whole, shall reflect regional and ethnic diversity of the people of Kenya.

The Committee noted that the chairperson of the PSC is already appointed and in office. It noted that unless the law prescribes otherwise, in future, the appointing authorities should submit to the House a complete list of nominees to be vetted for appointment to a commission.

Temporary Deputy Speaker, the Committee noted that composition of the Commission of the nominees were to be approved by the National Assembly looked at alone, would not reflect regional and ethnic diversity of the people of Kenya. However, the Committee noted that provision of Article 250(4) of the Constitution requires that the composition and appointment of commissions and independent offices be considered as a whole in determining whether the same reflects regional and ethnic diversity of the people of Kenya.
