  • 12 Oct 2021 in National Assembly: Hon. Speaker, I want to lend my voice to the issue that is raised by Hon. John Mbadi, as amplified by Hon. Peter Kaluma. I think it is an acute issue of conflict of interest. I would agree that if that is the issue, then it should not be an issue of postponement as Hon. Mbadi was suggesting, it should be an issue in which you rule that a Member who presents a Petition by way of a public petition can then not come and amend that public petition. By definition that becomes conflict of interest. The electronic version of ... view
  • 12 Oct 2021 in National Assembly: In addition to that, I have seen that there is more. If you look at the Petition as it is as amended, No. 17 has a problem. Number 17 is purporting to direct a constitutional commission how to do its work. That is expressly contrary to Article 249 of the Constitution. Number 19 has yet another problem, it purports to give direction to a Cabinet Secretary on how to deal with refugees contrary to the Refugees Act. The Refugees Act is very clear in terms of how to deal with refugees, who is a refugee and the refugee commissioner but ... view
  • 7 Oct 2021 in National Assembly: Thank you, Hon. Speaker. In the interest of time, first I support the petition by Hon. Atandi. This one by Isaac Njuguna is totally misplaced. First of all, it contradicts the role of State and religion against Article 8 of the Constitution. The electronic version of the Official Hansard Report is for information purposesonly. • 7 Oct 2021 in National Assembly: Secondly, under Article 9(3) of the Constitution, national and public holidays are to be prescribed. We as a House passed the Public Holidays Act as amended in 2012. It gives the Minister power to prescribe additional public holidays. The Petitioner does not need to come to us, but go to the Minister and persuade the Minister that alongside 11th October, let them add those other days. Thirdly, in any event, we do not just have one holiday for praying. Every week, we have at least two days. We Catholics have Sunday. The SDAs have Saturday. Our Muslim brothers and sisters ... view
  • 7 Oct 2021 in National Assembly: Thank you, Hon. Speaker. I hope the Chairman of the Departmental Committee on Administration and National Security, Hon. Mwathi, will listen. view
  • 7 Oct 2021 in National Assembly: And the Vice-Chair. I hope they listen to this. Hon. Speaker, you remember that last week on Thursday, I raised a Question by Private Notice addressed to the Departmental Committee on Administration and National Security. You directed that they bring an answer within 7 days. I seek your direction as to whether the Chair or Vice-Chair might be able to give us an answer today. view
  • 7 Oct 2021 in National Assembly: Yes, Hon. Speaker. That is fine provided that they give it on Tuesday. The family is in deep agony. view
  • 6 Oct 2021 in National Assembly: Yes, Hon. Speaker. I wanted to get your guidance given your prior rulings that on any Bill or Motion, if there is a matter of constitutionality it can be raised at any stage. I have a matter of constitutionality on the Proceeds of Crime and Anti- Money Laundering Bill. I wonder if I could raise it at this stage or we await for the Second Reading. view
  • 6 Oct 2021 in National Assembly: I stand guided, Hon. Speaker. view
  • 6 Oct 2021 in National Assembly: Thank you, Hon. Speaker. I rise to support this Bill. I have carefully looked at it and it resolves very grey areas in law. First of all, it seeks to consolidate three different prior pieces of legislation, each which sought to have a parallel regime. It rationalises them into one Act of Parliament. This Bill carefully balances the rights and obligations both the tenant and the landlord. We have had situations where landlords would mistreat tenants, and there would be no proper protection. But similarly, situations would arise where tenants would mistreat landlords using the provisions of the law. This ... view
