  • 28 Oct 2014 in National Assembly: I am only saying he is only leaning too much in favour of the miners by the numbers he is proposing. In addition, we really need to bear in mind--- view
  • 28 Oct 2014 in National Assembly: Hon. Temporary Deputy Chairman, I am sorry, I had made this request to contribute to the previous amendment. Nevertheless, I support the amendment with regard to custody to be with the Board in charge of rights. I support the amendment. view
  • 28 Oct 2014 in National Assembly: Hon. Temporary Deputy Chairman, from the definition of “dispute” under Clause 129, it is quite clear that the kind of disputes anticipated here are strictly not legal. I would say that they are operational disputes about boundaries and where pipes can be laid. This is the kind of matter which can be handled administratively. Only after that process has failed, or when the parties do not feel that, that is a satisfactory process, can they have recourse to the judicial process. In my view, it is an attempt to provide for a quicker remedy to parties. view
  • 28 Oct 2014 in National Assembly: Hon. Temporary Deputy Chairman, in my view, I agree with the Committee on doing away with the establishment of a tribunal. view
  • 28 Oct 2014 in National Assembly: That is right because the first port of call, if there is a really a legal dispute, should be the environmental court. We have created an environmental court to be a specialized court. Remember, the nature of interest in mining is bound to be quite substantial; it possibly requires technical and more specialized people. view
  • 28 Oct 2014 in National Assembly: Hon. Temporary Deputy Chairman, I am supporting the amendment. I welcome this invention by the Committee to help the country institutionalise the process of issuing mineral rights by removing them from an individual and making them open and transparent and, thereby, winning the confidence of all the stakeholders. view
  • 14 Oct 2014 in National Assembly: Hon. Temporary Deputy Speaker, let me take this opportunity to make a contribution on this. I am aware of what some hon. Members may have said about the CIC, but what is important for us to be clear is that the CIC is one of the independent commissions set up under the Constitution. They were not only appointed, but the House participated in approving their appointments. We are in the process of implementing this new Constitution which has created several institutions. It has set up several principals that, in themselves, are counter-checking each other and have entrenched the process of ... view
  • 14 Oct 2014 in National Assembly: What I also want to say on the substance of this debate is that I have no doubt in my mind that the National Assembly has every legal and constitutional right to summon Cabinet Secretaries even to constitute the Committee on General Oversight. That is perfectly legal and it is perfectly constitutional. But some of the concerns that are being raised - and I would not want to be dismissive of any - is this: In terms of effectiveness, those are issues that we are going to be dealing with, with time. If you look at the old ways of ... view
  • 14 Oct 2014 in National Assembly: Under the new Constitution, a situation where the National Assembly has 349 Members, it was considered that questions did not constitute business of the House. The real business of the House started after Question Time. Under the new system, we went to the Committee system. My understanding is that when we constitute committees, we are supposed to have people who have professional strength in the areas they will be supervising Government on. Those committees are supposed to be spending a lot of time The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this ... view
  • 14 Oct 2014 in National Assembly: and you can be sure that as they are working, it is Parliament working. But when it comes to the comedy hour as they call it in the Congress, it is the Congress on show or Parliament on show. That window of Parliament on show is a very narrow window and it does not give us sufficient opportunity to play oversight role as we would do in committee levels where we have a lot of specialized competence from Members of the committee and who are going to build on those skills over time. That is my view. view
