  • 12 Feb 2014 in National Assembly: an institution and it can actually take issue with decisions it feels are doubtful regarding what the I-G does. But it cannot be expected to be involved in day-to-day operations. More so, when it is not headed by professional policemen, it means that it is essentially a supervisory role with regard to overall responsibility of the I-G. It exercises provisory and developing policies. That means that even if the Constitution speak about transfers, promotions and so on and so forth, the I-G is part and parcel of that NPSC. So, there is a linkage between what he intends to do ... view
  • 12 Feb 2014 in National Assembly: Thank you. To water down the ability of the Inspector General to sustain an independent command, would really be to invite anarchy and chaos from the one Force that is in charge of maintaining law and order in the country. • 12 Feb 2014 in National Assembly: At the Third reading, we really urge Members to consider the specific areas rather than complain that the amendments are generating broad powers. We would rather look at these individual amendments rather than throw away this amendment Bill. With those remarks I beg to support. view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, Sir, I really do not think so. On the contrary, the requirement of the law is that there should be full participation and that independent interests are brought to bear on the input of the Media Council. So, I really do not see how unconstitutional that will be. view
  • 5 Dec 2013 in National Assembly: On a point of order, hon. Temporary Deputy Chairman, Sir. I thought that it ought to be clear that when we use the word “Parliament” as used to happen before, it denoted the “National Assembly”. But now that we have two Houses, it is very important in legislation that we be clear whether we mean--- view
  • 5 Dec 2013 in National Assembly: Therefore, I support the rationale that it is not proper to use the word “Parliament” when in fact, you mean “National Assembly”. view
  • 5 Dec 2013 in National Assembly: Thank you, hon. Temporary Deputy Chairman. With due respect, I am really not going against your ruling but you will appreciate that the proposed amendments are being introduced at the third stage. This means that they were not in the original Bill as published. The fact that amendments are being introduced at the third stage of the Bill means that the most substantive amendments to the insurance law are being introduced at the third stage. We are concerned because one of the principles enshrined in Article 10 of the Constitution is public participation, and not introducing amendments at last stage ... view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, I am saying that these amendments were introduced during the Committee Stage. They were not contained in the original Bill. That is where the concern lies. If you look at the implications, in terms of its impact on Kenyans’ fundamental right to compensation; you will appreciate that it is being capped at Kshs3 million. If a Kenyan gets involved in an accident and sustains a fracture, the claim, including medical expenses, do not add up to Kshs3 million. We have just considered the Wildlife Compensation Bill. We fixed the compensation for death of a person occasioned ... view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, Sir, I propose that Clause 3(a)(ii) which reads that “The maximum percentage of the sum specified in section 5(b) and prescribed in the Schedule under this Act shall be inclusive of the medical expenses on the judgment or claim”, be deleted completely. view
