On a point of order, Madam Temporary Deputy Speaker. The Minister has said that the proposal that we keep this year ought to be for completing the ongoing projects. Could he clarify what the Kshs17 million is for, if it is not to actually assist us complete some of these projects which we would not be able to complete within the proposals that we are going to give in the first allocation?

asked the Minister of State for Special Programmes:- (a) the cause of the current maize shortage in the country considering that there was no drought experienced in 2010; (b) why the Government has failed to stock the Strategic Grain Reserve (SGR) with maize at the appropriate time; and, (c) why the Government is importing maize at the high prices and yet the National Cereals and Produce Board (NCPB) did not purchase maize from local farmers.

Mr. Temporary Deputy Speaker, Sir, yes, I am. I am setting out the background to raise my point of order. The perception being put across the country makes us, as Members of this Committee, feel very frustrated. It is being implied that we are not in agreement or willing to meet. Nothing can be more misleading. The point is that we have been holding meetings and we are willing to elect a Chair, but certain forces within the establishment of Parliament are determined to paralyze this Committee. Mr. Temporary Deputy Speaker, Sir, I also want to oppose that proposed further amendment. The whole idea of this Revenue Allocation Commission is to be a policy development commission. It will have the ability to recruit precisely that kind of expertise that is needed. Therefore, we are not looking for technocrats as such. We are looking for people who understand the situation of Kenya and who will work with those other technocrats to lead. We should allow the discretion to those who will do the recruitment to look for suitable persons not necessarily restricted to technocrats.

Mr. Temporary Deputy Speaker, Sir, the point being missed here is that the independence of the Commission is very important. It is very important to safeguard the independence of the Commission. But, at the same time, it is important to make it obligatory on the part of the Government to support with expertise and any other information that this Commission may require. If you give it independence but deny it the capacity to access expertise in the Government, you will be giving the Government an opportunity to stifle the very independence you are looking for.

Madam Temporary Deputy Chairlady, I rise to support. Section 76 (2) of the Constitution clearly states that: “A state officer shall not maintain a bank account outside Kenya except in accordance with an Act of Parliament.” This provision is now being made to give effect to the provisions of the Constitution. So, it is really in keeping with the Constitution; I, therefore, support.
