Mr. Temporary Speaker, Sir, I rise to support this Motion for Adjournment in honour of Papa Francisco, born Mario Bergoglio on 17th December, 1936 in Buenos Aires, in areas where poverty ravaged the world. He grew up knowing what it is to be underclass. Papa Francisco will visit Kenya, Uganda and the Central African Republic. Kenya has had its own share of conflicts and has potential conflict. Mr. Deputy Speaker, Sir, I also rise to welcome our colleagues from county assemblies who may not be seeing me but may be the screen is showing me. Let me raise one point, that it is a very good practice for committees of county assemblies to come and meet with counterpart committees in the Senate. Mr. Deputy Speaker, Sir, the matter that the Senator has raised is very serious. I chair the Board of the Africa Cancer Foundation and we have done a baseline survey in ten counties in this country. We have also already done screening exercise in ten counties; screening about 13,000 Kenyans. We are screening mainly three types of cancers; cervical cancer, prostate cancer and breast cancer. Mr. Temporary Chairman, Sir, it is good to be clear on what we are doing. The point that Sen. Orengo has made needs a statement from you so that we know where we are going. As far as I know, what we have done was just to consider the recommendation of the President on a particular clause. Mr. Temporary Speaker, Sir, if you had given me the chance to speak earlier, this problem would have been solved. To err is human. When the Chair was speaking, having noted that the amendments or reservations that the President had proposed had been rejected in this House by a vote of 17 to 13, it is a fact that any vote taken while those same Members were in this House could not be negated. One of the most leading theologians, who is also a lawyer, Bishop Augustine of Hippo, said that in the court of conscience, there is no obligation to obey an unjust law. Mr. Temporary Speaker, Sir, I appreciate the points raised by the Senate Deputy Majority Leader. Being conscious of time is good, but this is a very weighty issue which involves a very important aspect of the Constitution as captured in Article 115. If we got that article correct, even in the order of the day, we would put the wording correctly by saying “President’s Recommendation” is constitutionally wrong.
