Thank you, Hon. Temporary Deputy Chairman. I beg to move:- THAT, the Bill be amended by deleting clause 69. The Committee proposes to delete this particular clause. Having allowed the Legal Aid Service to proceed and having allowed other persons who may not be affected apply for legal aid on behalf of the person affected, we do not see the need now for a person called an intermediary. Thank you, Hon. Temporary Deputy Chairman. The Service is established to ensure that the scenario contemplated under the clause does not arise. The Service has been established to ensure that there is provision of legal aid services throughout the country. So, there is really no need for this intermediary. We propose that the same be deleted. We have already allowed paralegals to also work. So, it is difficult to envisage any other intermediaries in a legal aid service or in justice matters.

Thank you, Hon. Temporary Deputy Chairman. I do not oppose this particular amendment. It will add value because it is not proposing any deletion. Clause 71 remains as it is in the Bill. It says that the Service can recover the costs it has incurred. If a lawyer or an advocate accredited is refunded for the costs incurred then the aided person surrenders the money incurred in terms of costs to the Service because he or she benefited from legal aid anyway. This particular provision adds value.

Temporary Deputy Chairman, I beg to move:- THAT, Clause 76 of the Bill be amended— (a) in sub-clause (2) by inserting the following paragraph immediately after paragraph (c)— “(d) extending the Service to as many beneficiaries as possible.” (b) by inserting the following sub-clause immediately after sub-clause (3)— “(4) the scale fees determined by the Service shall be less than the legal fee applicable to persons not aided by the Service.”
