Thank you, Hon. Temporary Deputy Speaker. I support the Bill. As the Leader of the Majority Party has just said, these are laws that are obsolete. They were enacted during the colonial time when there were different classes of people: the whites, the Asians, the Africans and the ordinary Kenyan who had laws governing each of them. So, these are laws that should not be there in an independent country and in the modern age of the 21st Century.

The good thing about this Bill is that it sets out a way of ensuring that the Act does not come to an abrupt end which will cause loss to the beneficiaries. In fact, Clause 4 is very clear, that there are transitional provisions where the Cabinet Secretary (CS), before winding up these Funds shall ascertain the status of claims against the Fund. Hon. Temporary Deputy Speaker, the Committee visited the LDK premises on two occasions and the latest one being in October 2021. Whereas LDK purported to have done what they are supposed to do, Erdemann maintained that they did not fulfil the requirements of the Report of the Committee on Environment and Natural Resources. In fact, the progress report by NEMA was disputed by Erdemann and they said that the effluent discharge was still going on.
