  • 12 Sep 2007 in National Assembly: Mr. Speaker, Sir, there exists a binding bargaining agreement duly signed by the parties on 1st September, 2006, and registered by the Industrial Court, thus making it legally binding to the parties. In conformity with the agreement, the Union has not complained of any failure by the employer to honour it, neither has the Union reported any trade dispute with regard to the same. Should there be a trade dispute, we expect the Union to report it to the Minister as provided in Section 4 of the Trade Disputes Act, Cap.234, Laws of Kenya. view

I am aware that Mr. John Nyosiro Rajuaji, a driver working for Dolphin Bus Services (Staff No.6-123) and whose services were terminated on 9th August, 2006, has not been paid his terminal dues calculated as two months salary and one month salary in lieu of notice. (b) Mr. William Mogambi Omwenga terminal benefits were deposited at the Industrial Area Labour office vide cheque No.000063 for Kshs39,798 drawn in Equity Bank Ltd. on 19th September, 2006. He has since received this full amount which included:- Two months pay in lieu of notice - Kshs14,740; twenty six days leave - Kshs7,370 and four years severance pay at 18 days per each completed year of service - Kshs17,688. He investigated and requested that the parties have a memoranda as required by the law. Again, the union responded, but the employer adamantly refused.
