  • 5 Dec 2013 in National Assembly: Hon. Speaker, Sir, I rise to support this particular Procedural Motion. The Standing Orders and any law for that matter, is supposed to be a living document. It is important that it moves, shakes and settles. It is important that we keep on looking at what we have and improving it. view
  • 5 Dec 2013 in National Assembly: We have had several months of use of this document that was passed by the last Parliament. We have learnt certain lessons, seen errors and have had difficulties. We have learnt a few lessons and we need to put those lessons into good use. Let us tidy up this very important document. Any time I go to Room 8 and see the volumes of documents that are printed and copied any other day, it is very clear that a lot of money is being put into use in giving us the Bills, Motions and other reports. Therefore, it would be ... view

  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairlady, I would want us to take this position. In the morning when we came here, we had a discussion which was to engage each other and have a bit of decorum. • 5 Dec 2013 in National Assembly: On my part, I fully support the amendments that had been agreed on with the Committee but the position is this: Neither this side nor that side is non-culpable. They are not guilt free. Both of us have not mounted enough numbers to sustain a two-thirds majority. view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, Sir, on this clause that is making it mandatory that an injured person is subjected to a medical examination at the request of the insurer--- It should read:- view
  • 5 Dec 2013 in National Assembly: “No judgment or claim shall be payable by an insurer unless the judgment debtor or claimant had, before determination of liability---” I want to insert there “at the request of the insurer”. Let us not make it the burden for the claimant where the insurer has not made that request. view
  • 5 Dec 2013 in National Assembly: Thank you, hon. Temporary Deputy Chairman. On page 615, my interpretation of the wording “(1B) The maximum percentage of the sum specified in section 5(b) and prescribed in the Schedule under this Act shall be inclusive of the medical expenses on the judgment or claim” is that--- view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, this amendment means that a person who is injured and incurs medical expenses amounting to, say, Kshs10 million or Kshs15 million, his compensation will be limited to Kshs3 million. This is a very bad clause, which we must reject. The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor. view
  • 5 Dec 2013 in National Assembly: Hon. Temporary Deputy Chairman, I propose that we deal with the amendment that hon. Sakaja has brought. view
