Hon. Chairlady, the reason why we are making these proposals is that when the courts are considering sentencing victims, it is important that the victims are given the right to make statements or to allow third parties, including the police in those circumstances, to record those impact statements on their behalf so that the court can make a determination that is both fair and just.

Unfortunately, I have a flu and so, I keep on losing my voice. I was saying that, as you know, hon. Ochieng is a member of the Departmental Committee on Justice and Legal Affairs and he has been part and parcel of this process. I think this was an oversight because Clause 5 contradicts Clause 2 and, therefore, I withdraw that proposed amendment; sub-clause 5.

Yes, thank you hon. Chairlady. We are making further proposals for inclusion in Clause 10. Again, those will be drafting issues in terms of cleaning so that it will be numbered so that it follows naturally as it is proposed.
