Thank you, Mr. Deputy Speaker, Sir. I rise to oppose this Motion. Even though my two learned seniors have made a case that sounds persuasive on the face of it, it nonetheless camouflages some fundamental issues which must be considered as we defeat this Motion - hopefully - in the best interest of this nation. Mr. Deputy Speaker, Sir, first of all, please, indulge me to commend this Assistant Minister for being so forthright on this issue of great national importance. It is emerging that this concessionaire has actually been engaging in economic illegalities. We also tabled some evidence here yesterday on this matter. It is emerging further that this concessionaire fraudulently entered into this concession. Would the Ministry be prepared to take legal action against this concessionaire at the end of these investigations? Mr. Deputy Speaker, Sir, I think it is critically important for it to go on record that what the Minister has attempted to indicate here that the Privatisation Commission did participate in the Safaricom Initial Public Offer (IPO), is manifestly misleading. Part (iii) of the Privatisation Act is very clear as to how the privatisation programme is to be generated by the Privatisation Commission, approved by the Cabinet and then implimented by the Commission itself. Mr. Deputy Speaker, Sir, is the Minister aware--- Could he confirm to this House that, indeed, the reason why the Government issued a default notice to RVR is because of the fact that it is a phoney company linked to high-ranking State officials which was cheekily misrepresented to the public as a foreign investor when, in fact, it is a phantom that has been deliberately crafted to defraud the people of Kenya of a premium State asset in the form of Kenya Railways? Mr. Deputy Speaker, Sir, that company had gone through a somersault of a process in 95 days from some queer entity called Cuba Investments up to the time it came to be called RVR. Allow me to lay these documents on the Table which also proves that, that company is linked to high ranking State officials, one of who sits at the State Law Office and, therefore, is in a vintage position to influence the irregular registration and incorporation of RVR as part of that grand fraud!
