I wish to remind him that Clause 194 (1) says: “The Cabinet Secretary may”. The word used is “may” and not “shall”. I wish to state that Kenyans have been hurt. The basis for this particular amendment of ensuring that there is public participation is that community land is vested with the county governments. Constitutionally, legislation of this nature should be done in consultation with the National Land Commission (NLC).
