Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT Clause 33 of the Bill be amended- (a) in sub-clause (1) by deleting the words “and in the restoration of peace in any part of Kenya;” (b) by inserting the following new sub-clause- (2) The Defence Forces may, with the approval of the National Assembly, be deployed to restore peace in any part of Kenya.

Mr. Temporary Deputy Chairman, Sir, while I empathize with what the Assistant Minister has said, we only need to familiarize ourselves with Article 241(3(b) which says that the Kenya Defence Forces shall assist and co-operate with other authorities in situations of emergency or disaster and report to the National Assembly whenever deployed in such circumstance, and may be deployed to restore peace in any part of Kenya affected by unrest or instability only with the approval of the National Assembly. So, even if this is deleted, it is clear in the Constitution. Again, we have to decide on what we ...
