Mr. Temporary Deputy Speaker, Sir, if that definition is not going to be done and the Commission to be set up is going to follow in the footsteps of the Ligale Commission, which is going to ignore all the other factors, then justice will not be achieved for the country. As the name suggests, this is the Committee on Legal and Justice Affairs. Therefore, we must be seen to be doing justice to the country. Let us not preside over impunity. Let us allow the new Commission to be set up to have a free hand in fairly determining the ...

Mr. Temporary Deputy Speaker, Sir, I am not talking about the Committee that has practiced impunity. I am saying confidently and I submitted to the Committee, that the product of the Ligale Commission was not just and fair. That is what I am referring to, for the record.

Mr. Temporary Deputy Speaker, Sir, while proceeding in seconding this Motion, I submitted here, when we had the Kamukunji that gathered in this Chamber; 222 hon. Members willing to serve and care for the nation in a very fair and transparent manner. In allowing this amendment, we shall be able to give opportunity to the new Commission to look at fairly what the Ligale Commission has done and correct accordingly so that Kenyans get what they desire.

Mr. Temporary Deputy Speaker, Sir, if I may refer to what we submitted, North Horr is 38,000 square kilometres. The whole of Upper Eastern is 20 per cent of the nation. If somebody comes around and tells us that the whole of that mass of land is going to be ignored as if it does not belong to this country, it is not fair. The population of Moyale is said to be 103,000 as per the population census. We wrote to the Minister of State for Planning, National Development and Vision 2030 and disputed that. That is not fair because ...

On a point of order, Mr. Deputy Speaker, Sir. I also agree with the hon. Members who have said that we are interfering with matters of another nation and it is not right. Dr. Khalwale has just said that the Sudanese in some parts of Kenya will vote. Indeed, the Sudanese will vote wherever they are. Even those in the United States of America (USA) will vote. Those countries are not interfering with the referendum. Let us not act like a big brother of some sort to our neighbours. Indeed, if other people dictate to us, it is irritating and ...

Mr. Speaker, Sir, I beg to reply. (a) Yes, I am aware that there are Kenyan IDPs who sought refuge in Uganda during the 2007/2008 post-election violence. (b) My Ministry, in liaison with the United Nations High Commission for Refugees, is urging all those who remained in Uganda to return home. You realize that from the 640 households that fled to Uganda, already 219 have been persuaded to come back and have been settled in Kenya. The remaining persons are being urged to return and follow suit. A further group of 79 households will return to the country on 8th ...

Mr. Speaker, Sir, I agree with you that I do not have any question there. He has just confirmed that we are making those efforts and we shall step up our efforts. I have said a minute ago that we are expecting a group of 79 members to come tomorrow from Uganda. We all appreciate the fact that once they are outside our soil, it is the mandate of the UNHCR. Ours is just to support them and that is exactly what we are doing.
