Temporary Deputy Chairlady, I just want to draw your attention to the fact that Clause 9 makes references to the allocations for 2021/2022, which we have already deleted. So, it is overtaken by events and it should not even exist. Reference to 2021/2022 was already deleted, anyway. So, we have two choices; we can just negate it and it will die rather than just deleting it administratively. Just for the purposes that this is something that is overtaken by events and voting for it is otiose, we must as well negate and get it off the Bill. view

A certified version of this Report can be obtained from the Hansard Editor. view
  • 2 Dec 2021 in National Assembly: any references of allocation of money in this generic Bill, the First Schedule and the Second Schedule have been overtaken by events and need to be removed. In the absence of an amendment by the Committee, I want to ask the Committee of the whole House to reject these two Schedules, so that we clean up the law. view
  • 2 Dec 2021 in National Assembly: Hon. Temporary Deputy Chairman, I am not sure whether Hon Kajwang’… He was a Member in the 11th Parliament as well. The Mwongozo code was actually tabled in this House by my predecessor and became part of the records of this House. Hence, the continuous reference to the Mwongozo code is because it was tabled and accepted as a document of the House. That is why we keep referring to it.   • 2 Dec 2021 in National Assembly: Indeed, Hon. Millie is right to highlight some of these things. Clause 39 had two sub-clauses defining “former Institute” and “appointed day”. The former Institute is now defined under Clause 2 through an amendment that we will consider. Appointed day is now being changed to ‘upon commencement of the Act.’ One of the matters that were in Clause 39 is transferred to Clause 2, where other definitions are. The other one is being changed under Clause 41. So, I think we are all together now. view
  • 2 Dec 2021 in National Assembly: For clarity, the responsibility of this House is to enact the Bill, which is then transmitted to the Head of State for assent. Once that is done, it is the responsibility of the Executive to implement. It leaves this House. If it is not implemented, the Departmental Committee on Trade, Industry and Cooperatives can summon the Cabinet Secretary to ask why certain sections have not been implemented. Our role as a House is to legislate. view
