The Joint Committee was established after the terror attack on Westgate Mall on 21st September, 2013. The Committee was constituted with a view to establishing the circumstances leading to the terror attack at the Mall and whether there were any acts of commission and omission on the part of the intelligence and security organs in the country. So, the Committee further extended the scope of its mandate to cover other areas that have been affected by terrorist attacks; such areas include Garissa, Mandera, Wajir or the former North Eastern Province, and Kilifi in the Coast region.

The Committee held its first sitting after 21st September, 2013 and drew up the following terms of reference:- (i) The Joint Committee had the mandate under Standing Order No.216(5) to investigate, inquire into and report on all matters surrounding the terrorist attack on the Westgate Mall; (ii) The Joint Committee, in carrying out its mandate may inquire into any acts of omission and/or commission that contributed to this attack; (iii) The Joint Committee may inquire into past terrorist attacks, including the findings and actions that may have been taken by relevant departments and agencies to bring the perpetrators to justice; ...
