Even as I rise to support the adoption, it is very sad that we are discussing the Reports of 2008/2009 and 2009/2010. I would like to bring to your attention the provisions of Article 229(4) of the Constitution which makes it mandatory for the Auditor-General, within six months after the end of a financial year to submit a report on audited accounts of Government entities. I am happy with the clarifications that the Chair of the Committee on Public Accounts has given to us. The reason why I am happy with that is because I think even in the preamble of this particular Report, we see the provisions of Article 226 of the Constitution which intend to hold public officers accountable. Year in, year out, there are many incomplete buildings and construction works. Actually to an extent, I really appreciate because a couple of days ago--- Of course, I am aware of the fact that the National Construction Authority is trying to harmonize and put in place schedules of both contractors--- We really need a body that is going to deal with errant contractors; in addition to just blacklisting them, we should also apply penal sanctions against contractors, so that the public does not waste a lot of resources. There are people who merit to be appointed to these positions. If you look at the Report of the Departmental Committee on Justice and Legal Affairs - which we looked at properly - you will find that the people who were ranked number one and two were not picked for the post of chairperson. • 4 Mar 2014 in National Assembly: Hon. Speaker, he was not appointed as a commissioner and the reasons for his not being appointment were not given. The persons who were appointing settled for the third person. Whereas I am a Member of the Committee and I am inclined to support this Report, I am just saying that it is a worrying trend in terms of the country not giving chance to meritocracy for whatever reasons. I think if we allow this sort of trend to continue, it will be one that is unfortunate. view
• 4 Mar 2014 in National Assembly: The other aspect is that Article 55 of the Constitution gives credence to the fact that young persons and people from minority communities should be given a chance. If you look at the persons who have been appointed, none of them fits within the particular bill of being a young person, whereas in my opinion, there are people who are young and ought to have been given a chance to represent Kenyans in that particular Commission.
