On enforcement, I have already said that the CG has all the powers to enforce the tax laws. We expect that collections will go up. We have seen people who do business today, make a lot of money and do not pay taxes. Tomorrow, they change their company’s name and call themselves by another name. This Bill is tightening the nuts. It provides that if, for example, you change your business premises, address or the structure of your shareholding, then you are supposed to notify the CG within the shortest time possible, so that it is known that you have ...

I want to thank the Members who have contributed, starting with the Members of my Committee. We will be bringing the necessary amendments. The Bill provides for clear ICT mechanism for payment, but we have heard some Members saying that we cannot bring these all at once. There could be businessmen who are illiterate and we want to see how to bring them on board gradually, because we want to have everybody on board. Many penalties have been provided, but I am not going to mention them. At least, there are penalties for every offence that is created.

I have heard some Members talking about corruption. Corruption is bad, and it affects tax collection. However, it is everywhere. Some Members seem to be pointing at one direction. It is everywhere, be it in Opposition or in the Government. If we look at corrupt practices, they are everywhere. It is incumbent upon this House to ensure that we all live up to the expectations of Kenyans. With those few remarks, I support the Bill. I urge the Members to support it, so that we can simplify our tax procedures.

Thank you very much, Hon. Temporary Deputy Chairman. First of all, I wish to inform the House that all the amendments that are before us are reversing all the amendments that this House passed when we were passing the Bill. There is a trend in this House. I even heard the Speaker reading another Memorandum that all the Bills are being transformed into constitutional Bills by a certain group of people who have led the House and noted that all of you cannot raise two-thirds majority. A few people calling themselves advisors are sitting somewhere, waiting to make the law ...

Hon. Members, you are elected to make laws in this House. I was also elected to make law. I am a Chairman of a Committee that has 29 Members. There is no way a Cabinet Secretary can advise the President to rubbish 100 per cent of the amendments which the Committee has done: 349 Members cannot be wrong unless you admit that we are fools in this House. I want the House to rise and take back its power because some people are taking it through the back door.

This is something this House had considered and approved to reduce the rate from Kshs10 to Kshs5. After conducting the public hearing process, in which we spent a lot of money listening to the public who are the stakeholders, ...
