Thank you, Mr. Temporary Speaker, Sir. I want to make a disclosure. The disclosure is that I come from Kakamega County and just the other day, when I was old enough to see with my eyes, there was no place called Vihiga in Kakamega. Vihiga was just one of the divisions in Kakamega. It then became a district and then a county. We were all happy, but today, we realise the folly of separating Vihiga from Kakamega. If you allow me, I want to suggest that we stand down this debate and consult further. I will say something that has run through my mind for a while. It is true that the formula must confine to the Constitution; the Constitution speaks to equity and not equality. The only way to bring up the 11 other counties that are affected adversely by the formula is increasing the equal share. If you increase it too much, then you will have negated the Constitution, which speaks to equity and not equality amongst counties.

We always divide money between counties in the County Allocation of Revenue Bill (CARA). If by happenstance, we allow this formula or some other improved formula to go through, we should remember that we have got 11 counties that require to be supported when legislating CARA. What do I mean by that Mr. Temporary Speaker, Sir? If the shareable revenue will be Kshs465 billion, nothing stops us from pulling out and ring-fencing Kshs11 billion. With that, we can have Kshs1 billion for each of those 11 counties. They will then all start above Kshs6 billion then we share. It is doable through legislation. If we go through the formula, we will be challenged in court because we shall have attacked the principle of equity, which is not equality. Thank you, Mr. Temporary Speaker, Sir.

Reading through the Bill, Mr. Deputy Speaker, Sir, the National Assembly tends to overemphasize what the Government has called national interest. On another day, I will challenge either the Deputy President, because he was the first to speak to it, and these MPs, to tell Kenyans what exactly they mean by national interest. Are you saying that some of the functions done in county governments do not carry national interest with them? Really? Agriculture that feeds the Republic is a function of grave national interest. Mr. Deputy Speaker, Sir, we expect a dual courage from Nairobi to Nakuru and to the Mau Summit. At that point, we expect that dual carriage to go into two branches. One branch to go to Kericho, then to Kisumu and from Kisumu to Kakamega. From Kakamega, it should join the other branch at Kaburengu in Webuye.
