  • 26 Jul 2016 in National Assembly: We know very well that after the Public Audit Act was passed here, we even have a matter in court pertaining to the independence of public audit. This clause is trying to interfere with the independence of the Auditor-General. This should not be entertained because of the reasons I have given. view
  • 26 Jul 2016 in National Assembly: Clause 13 proposes a new Section 39A of the Act that provides for the process of approving expenditure for purposes of the National Assembly. It is already provided for in the Constitution, but we do not want governments to take advantage that we have this provision and circumvent the role of the National Assembly. In the presidential system, the National Assembly is a budget-making House and it is, indeed, important that all budget making processes pass through the House. The issues of the Budget Policy Statement, the passing of the Estimates and the passing of the Appropriations Bill must all ... view
  • 26 Jul 2016 in National Assembly: Clause 14 of the Bill duplicates what is in Clause 13 going to Clause 14 where it says, “to insert Section 42 (a) of the Act to provide for the process of approving expenditure before the County Revenue Allocation Act”. When it comes to the county level, sometime back we had issues with the Division of Revenue Bill. I remember last time the Senate went to the Supreme Court for a legal advisory. In such circumstances where passing of the Division of Revenue Bill has been delayed, Clause 14 is going to be very handy in helping county governments to ... view
  • 26 Jul 2016 in National Assembly: Looking at Clause 43 of the Bill which is proposing to insert Section 131(a) of the Act to provide for the process of approving expenditure before the Budget Estimates are approved by county assemblies, we hope governors will not take advantage of this clause. I am saying this as earlier speakers had mentioned. You find governors spending money on items that have not been approved by the county assemblies. This is where we must do a lot of checking. Clause 43, much as it is coming in to help during extraordinary challenges, we hope the governors will not take advantage ... view
  • 26 Jul 2016 in National Assembly: run for governorship. Some governors are asking if their challengers have what it takes. We have seen some governors stating that they must be given an automatic party ticket as they defend their seats for the second term. This is because of the loophole in the law as far as this levy collection is concerned. Clause 33 of the Bill proposes to amend Section 109 of the Act to facilitate easy operationalisation of the Treasury Single Account. This is key because when county governments have several accounts at the Central Bank of Kenya (CBK), it becomes very difficult for purposes ... view
  • 21 Jul 2016 in National Assembly: Thank you, Hon. Speaker. I would like to comment on the petition that has just been presented to the House. A similar petition was previously presented here by the incoming governor for Tharaka Nithi, Hon. Muthomi Njuki. Hon. Speaker, we cannot be legislating, overseeing or representing in vain. This matter is supposed to have been handled a long time ago. As we move on, because of the climate change, we see regions which previously had favourable working conditions becoming difficult areas. It is important that the ministry in charge moves with speed and reviews this matter with a view to ... view
  • 20 Jul 2016 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. I rise to support this Bill. I was wondering why the Senate took long to bring this Bill here. It has been long overdue; no wonder we have had chaos in the county assemblies. Article 117 of the Constitution provides for freedom of speech and debates in Parliament, the Senate and the National Assembly. At the county levels, we have county assemblies which play oversight and representation roles. When it comes to oversight, we must provide immunity against civil or criminal proceedings. This Bill has been long overdue and it is going to allow ... view
  • 20 Jul 2016 in National Assembly: As we move on, the Committee on Powers and Privileges has to be put in place. This is a wonderful idea. We have seen chaos in the proceedings of some county assemblies. In Makueni County, we recently saw people shooting at each other. We saw the same in the Kisumu County Assembly. I have seen such chaos in Trans Nzoia County. We have seen this in Nyeri County too. The lives of county assembly members should not be the same as the lives of the former councillors. Councillors were there for representation but Members of the County Assemblies (MCAs) are ... view
  • 20 Jul 2016 in National Assembly: Hon. Temporary Deputy Speaker, I listened keenly when my friend was moving this Bill. He mentioned Article 195. I want to put it correctly. He is a senior lawyer. He mentioned Article 195 yet it is supposed to be Article 125, which talks about evidence of power. You can check the HANSARD. I think it is important that we do those corrections. As we move on, the Powers and Privileges Committee needs to be flexible. We have seen what happened with Hon. Wandayi’s case. As this issue is cascaded down, it is important that it is checked on a case ... view
  • 20 Jul 2016 in National Assembly: With those remarks, I support the Bill. view
