Thank you, Hon. Speaker. I wish to support this Motion and in doing so, state that this is not the first policy paper we have got on these issues. The papers have been written and they are known by all Kenyans. Policies have been issued and they are known by all Kenyans. The Constitution is very clear, particularly Article 10. What is missing is that the entire leadership of the Republic is treating leadership as a business. It is time we changed the law so that before you are appointed a CS, PS or in any position of authority where you will be allowed to take rent, we start by a report to the vetting authority of your lifestyle. That can be repeated annually. If you want to make money from a position of authority, leave that position and go and do your business in competition with the rest of the world. What we are publishing is not taking us anywhere. We need a clear resolution that time has come and we have to change .We need to look at it carefully and cut off. I was with the former President of Nigeria, Olesegun Obasanjo the day the Egyptians took Hosni Mubarak in a cage to court. As a former President of a Republic in Africa, he really felt pain. The Chair of the PAC can answer all the questions. However, if the Speaker of the NA is in the Chair where we have to question the Speaker of the Senate or somebody of that high rank, because I doubt whether we will ever have the President coming to give evidence before any committee--- Since it is you the Speaker of the NA that will preside over a tribunal to discuss the removal of the CJ, and if he has to answer personally to a committee of the House, you should preside over those proceedings and let the decisions come. ...

Those modifications would help us preserve the dignity of the Judiciary and observe protocol issues that would arise because the Constitution provides that you would chair a tribunal to remove the CJ. We have no provision of who would chair a committee if the Speaker of the Senate has to personally answer on issues before any of our committees. Now that we have reached where we are, I would suggest, therefore, that we agree to adjourn this debate so that you preside over the PAC jointly with the Chair of PAC, allow the CJ to appear before you to answer ...

We also hope that the dignity of the House, represented by the Speaker of the House, would be preserved in as many proceedings as may be necessary as we strengthen the governance structures in this country. Thank you, Hon. Temporary Deputy Chairman. What we are facing is a conflict between two key organs of governance. Certainly, the Presidential reservations are works of the Executive whether they are advisors, ministers or whoever they may be. They are the work of the Executive. Traditionally, the Executive has always had a strong interest on any legislation that has financial impact. Thank you very much, Hon. Temporary Deputy Chairman. Honestly, the amendment is not an improvement. The original Clause 37 was already very bad. We can do with the current provisions under which it is the Serjeant-at-Arms that has the powers to exercise some of those functions. So, we should find a mechanism not only of rejecting the amendment, but also withdrawing the previous Clause 37 as it was. Those would be my observations.
