Fact number four, the new Executive has to live with the changes that empowered the PSC, which has previously been abused substantially by the Executive, and, maybe, the Cabinet Secretary was not keen enough to have noticed the differences between past practice and the requirements under the current practice.

Personally, I would not sanction an officer for being overzealous. I would teach the officer to deliver within the law henceforth. What we are trying to do goes beyond an Executive action, or an administrative action. It is apparently a political action, and I think, if we want to use constitutional argument, we are not fair to the Cabinet Secretary in this circumstance. I, therefore, want to plead with the Members. Why did the two committees give us a very blunt report that tells us nothing? Without the amendment, they were telling us to do something, which is already done ...

Hon. Temporary Deputy Speaker, thank you very much for this brief opportunity. First of all, we are really headed for serious social confusion in this country. There are other deviant social behaviours that are also proportionately increasing in our Republic. It is not just rape; it is not gang rape alone; it is not defilement alone; it is not incest alone but we also have gay life increasing in large numbers. My hypothesis is that all these go in the same direction with the single life that is increasing in our country. In our old society, nobody was allowed to be without a wife. If you could not afford it the clan was responsible and women were given the power to discipline these men. Science tells us that as hormones build in the male, they can even become insane. Thank you, hon. Temporary Deputy Speaker finally for giving me this chance. As we draw to the close of this debate, I know you will remember that this is one of the few commission positions that were remaining with after the Salaries and Remuneration Commission (SRC) was done and we have another two slots for the Parliamentary Service Commission.

I have to bend a little. Hon. Temporary Deputy Speaker, I want to draw the attention of the House to Article 250(4) of the Constitution. I wish to read it as we draw towards the close. It says: “Appointments to commissions and independent offices shall take into account the national values mentioned in Article 10, and the principle that the composition of the commissions and offices, taken as a whole, shall reflect the regional and ethnic diversity of the people of Kenya.” The electronic version of the Official Hansard Report is for information purposesonly. Hon. Temporary Deputy Speaker, we only have a few slots remaining and it is important to point out that we may breach this provision, that certain regions or certain ethnic groups have too many of these appointments to commissions at the loss of other regions and ethnic groups. I point out that because I have seen somewhere one county has several commissioners and there are several counties in whichever way you may want to describe Kenya, whether by the old provinces or in any other respect or by ethnic groups.

Hon. Temporary Deputy Speaker, so, my last point is that I support this Motion and we should be very furious with panels that have been appointed under the law. Never take the House for granted and never expect that when we are doing our critical role in vetting, the Republic is in competition with the rest of the world and being in competition with the rest of the world, a commission like the TSC---
