going to leave our families… I know you cannot tell when you will die, but let us work with wills for us to solve these cases. This way, we will relieve families of any constraints. The other thing we need to see in terms of property and respect in the society is men and women recognising good morals in life. If you have a partner, live openly by declaring whether you are a one- man-one-wife or if you are one-woman-two-men kind of person. This will make sure that everything is mentioned in your will. I will not forget to congratulate ...

Thank you, Hon. Temporary Deputy Speaker for giving me this opportunity to affirm the legislative process of this piece of law. I also thank the Leader of the Majority Party for coming up with the business at this time when our economy has been constrained by the COVID-9 Pandemic. It is true that where we are going, we need to register some progress in what we are doing in this country. This country is still lagging behind because we are doing things the way we used to do them in the 1960’s. The Law of Contract is a very big ...

the business you are doing. Considering the huge traffic jams we have, this is the best time we need to come up with measures on how we can deal with things of the Law of Contract. Providing for signing of the Law of Contract digitally is a way of making doing business easy. So, I appreciate the fact that in the Law of Contract, we will have a provision for digital signing of documents. Previously, signing documents digitally was not considered legal. Looking at the Registration of Documents Act, this is where Kenyans cry a lot when they seek to ...

Thank you, Hon. Temporary Deputy Speaker, for giving me an opportunity to deliberate on this Bill. As we pass this Bill, there are aspects that we need to understand, especially on admissibility of these Bills when they are brought to this House, that is, how that process is followed. I belong to the school of thought of my able Chairman, Hon. Jeremiah Kioni, on our understanding of the admissibility of the Bills in this House. I have seen our able Chairman of the Departmental Committee on Justice and Legal Affairs bringing a report. The question is whether we need a ...

of registering committees at the level of constituencies. People will tend to say that there are several committees that need to be registered in the constituency. So, we need to describe very well what these committees are, who is supposed to register them and their duties. The other issue I have seen in this Bill and which may bring inconsistencies is the petitions. In matters of a referendum, a petition is very important. It has to be described very well, point to point, how it is supposed to be followed. This Bill has not given the security cost of a ...

It is true that land matters are sensitive and we have a lot of problems. In the last Petition, in his prayers, the Petitioner is requesting that we revoke a title deed which has already been issued. That matter is very sensitive and there is need to do due diligence especially on ownership. I do not want to demean the Petition but I want to request the Departmental Committee on Lands to carry out due diligence especially on the title deed and ownership. There is a lot of confusion when it comes to land matters in this country. The right ...

Recently, we saw a scenario in Ngong where people could co-operate to get you an official search but later on, you are told that the search is not the right one. The land matters are sensitive. As per the prayers of the Petitioner, in my view, we cannot rush to revoke an entity with ownership. I want to ask the Committee to undertake proper due diligence in this Petition. Thank you, Hon. Speaker.

Thank you, Temporary Deputy Speaker, for giving me the opportunity to articulate on the Sessional Paper on the National Policy on Gender and Development. This policy has come against the goodwill of Article 27(1) where you understand that the Kenyan community grows from our culture where women used not to inherit land. Women were property. They could not engage themselves with education in the community. Women were not supposed to inherit land and that is why you see now Article 27(1) expounds on the equality of men and women. The same policy on Article 27(3) gives women the right to ...

I congratulate this House for having shown a proper progressive test in articulating Article 100, by bringing policies on the gender rule. In the statement from the advisory from the Chief Justice, he did not consider Article 27(8) which talks about two-thirds gender rule on the political organs, departments and ministries. My question which comes to bring a conflict of the law is, if today you say that this House needs to have two-thirds gender rule, are you saying that the voters who elected us to this House did not know what they were doing as they elected us? The ...
