THAT, Clause 2 of the Bill be amended by inserting the following new definition in its proper alphabetical sequence- “Kenya Police Service” means the Service established under Article 243(2) of the Constitution.

Mr. Chairman, Sir, the justification for this amendment is that the definition was mistakenly omitted from the Bill. The other services like the Administration Police Service are defined in the Bill.

Mr. Chairman, Sir, I beg to move:- THAT, Clause 10 of the Bill be amended in paragraph (m) of sub-clause (1) by deleting the words “including arranging to pay compensation to victims of police misconduct.” Mr. Chairman, Sir, the justification for this amendment is that the payment of compensation to victims of offences, including the police misconduct shall be taken care of by a separate legislation to be enacted by Parliament, pursuant to Article 50(9) of the Constitution.

“or equivalent qualifications.” Mr. Chairman, Sir, the justification for this amendment is to give a chance to applicants for the position of Deputy Inspector-General who may have qualifications equivalent to a university degree. These qualifications include a Higher National Diploma from recognized institutions.

THAT, Clause 12 of the Bill amended- (a) In sub-clause (1) by deleting the words “or Deputy Inspectors-General”; (b) by deleting sub-clause (5); (c) in sub-clause (13) by deleting the words “and the Deputy Inspector-General” Mr. Chairman, Sir, the clause is being amended for two reasons. The first is to exempt the two Deputy Inspectors-General from Parliamentary approval of their appointments. The reason is to remove the selection panels and let the National Police Service Commission initiate the recruitment of the position of Inspector-General of Police.
