  • 7 Aug 2014 in Senate: Mr. Speaker, Sir, I want to join my colleagues in thanking you and congratulating you for the very well thought out communication that you have made to this House and the nation at large. This goes a long way in correcting the falsehood that has been created out there that the Senators want to usurp the powers of the Governors and be in charge of funds. Nothing could be far from the truth. On the contrary, we do not want to be in charge of any funds. We know our constitutional role is legislation and oversight and we will stick ... view

  • 6 Aug 2014 in Senate: On a point of order, Mr. Temporary Chairperson, Sir. I do not wish to challenge your decision. However, if we go by the Order Paper, I think my amendment comes first. If you notice, the amendment by Sen. G.G. Kariuki is actually my The electronic version of the Senate Hansard Report is for information purposes only. • 6 Aug 2014 in Senate: Mr. Temporary Chairperson, Sir, I rise to support the amendment moved by Sen. G.G. Kariuki. But before doing so, I would like to say that when this Bill was moved, I was away. However, I had drafted a similar amendment. Let me take this first opportunity to thank Sen. (Dr.) Khalwale of Kakamega County for bringing this Bill. It is a very good Bill. Before we pass the Bill, it is at the whims of the governor and the executive to decide to move the county government The electronic version of the Senate Hansard Report is for information purposes only. ... view
  • 5 Aug 2014 in Senate: Mr. Chairman, Sir, it is not really a point of order, but an intervention. I have heard all my colleagues who have spoken in support of the amendment and have a different proposal that I want to put forward. I am conversant with the two buttons and I pressed both. I want to contribute and make an intervention at the same time. view
  • 5 Aug 2014 in Senate: Mr. Chairman, Sir, let me, first of all, begin by thanking the Chairman of the Committee for bringing this amendment. I think that he did it in very good spirit, and I am sure that he means very well. I want to plead with my colleagues and refer them to Article 187 (2) (a) and (b) of the Constitution. If we pass this amendment that has been proposed by the Chairman for the Committee on Finance, Commerce and Budget, Sen. Billow Kerrow, we will be setting these hospitals and counties to fail, for sure. This is because clearly, the monies ... view
  • 5 Aug 2014 in Senate: Mr. Chairman, Sir, Standing Order No.88(1) has been breached by none other than the Senator for Nandi. This is the Standing Order that talks about anticipating debate. It is very clear that Standing Order No.88(1) says that:- “It shall be out of order to anticipate the debate of a Bill which has been published as such in the Gazette by discussion upon a substantive Motion or an amendment or by raising the subject matter of the Bill upon a Motion for the Adjournment of the Senate.” The electronic version of the Senate Hansard Report is for information purposes only. • 5 Aug 2014 in Senate: Mr. Chairman, Sir, I stand to support the amendment on the amendment that was moved by Sen. (Dr.) Khalwale. I think he cited Article 216 of the Constitution. Indeed, the amendment brought by Sen. Mutula Kilonzo Jnr., as it was, contravened the provisions of Article 216. I just want to bring it to the attention of Members who may not know, that even if we went ahead and passed that particular amendment as it was brought, somebody could have challenged this. This is under Article 2(4), the supremacy of this Constitution which states:- “Any law, including customary law, that is ... view
