In short, we are removing adjudication of community land from being a Government driven process to a community driven process, so that a community can determine who is supposed to own private industries on their land.   • 2 Mar 2016 in National Assembly: I will jump to Clause 21, on conservation and management of resources in community land. Indeed, we should underscore the provisions of Article 62 of the Constitution which classify all minerals and mineral oils as public land. I also agree with fellow members on the procedure for conversion of community land into any other type of land and insist that two-thirds of the Assembly must ratify any such decision.   • 2 Mar 2016 in National Assembly: My time is almost over. Clause 46 is the saving and transitional provisions clause. I want to indicate that the saving clauses must be subject to the powers of the National Land Commission (NLC) to review any dispositions and grants pursuant to Article 67. So, that any abuses of the Trust Land Act that enables people to disenfranchise communities can be reviewed and such abuses rectified.   • 1 Mar 2016 in National Assembly: Thank you, Hon. Temporary Deputy Speaker. I have sat through the whole afternoon because this is a very important Bill and I am a Member of this Committee. I only have two minutes and I would like to address some of the fears the Members have raised. In the amendments that our Committee will bring to this House in the Third Reading, we have redefined “community”. We have also clearly specified how a community can be created and registered for purposes of owning community land. We have also created a fool proof mechanism on how community land is identified. view

As a Committee, we have also had extensive discussions with caucuses and most of them know what we have agreed with them. I am advising the caucuses and Members who have identified clauses which they see as offending in the Bill to access the amendments that we have proposed, internalise them and assuage their fears. Generally, I support the Bill, save for a few amendments that will be necessary during the Third Reading. The strict reading of Article 71 of the Constitution, outlaws some of the exemptions of classes of transactions in the Bill, especially the sweeping Clause 4(2)(b), which says that the grant of a concession or aright by a private person to exploit a natural resources through an agreement or a contract, could mean very ... view
  • 10 Feb 2016 in National Assembly: Hon. Speaker, the procedure of handling these agreements when presented to Parliament provides a clear roadmap of how mischief can also be avoided. This Bill, for the first time now, subsequent to the promulgation of the 2010 Constitution, makes it mandatory that the natural resources of Kenya truly vests in the people of Kenya. Exploitation of such natural resources must be ratified by elected representatives of Kenya; to exercise the sovereign will of the people, in granting such permissions.
