Madam Temporary Deputy Speaker, let me join my colleagues in congratulating the Minister first and foremost and the team that negotiated this consensus. To my mind this demonstrates the future that we can have in this country. It is not necessary that we should have showdowns on issues that can be negotiated. This is a law for all the Kenyan people, all races, all ethnic groups, all religions and I am happy that it is a product of a consensus process. I thank everybody who was involved in it. Thank you.

Mr. Speaker, Sir, yesterday, Tuesday 25th September, 2012, the Temporary Deputy Speaker directed the Attorney-General to issue a Ministerial Statement on the issues raised by Mr. ole Ntimama and Mr. Waititu regarding the killing of three Maasai youths in Kayole, Nairobi County. I am pleased to make the Ministerial Statement. On or about 23rd September, 2012 an incident was reported in which the Assistant Minister for Water and Irrigation, Mr. Ferdinand Waititu, was reported to have made remarks to Kayole residents that incited them to cleanse the area of members of the Maasai community, living and working in the area. ...

Member for Kilgoris, I want to confirm that the Government takes very seriously, from now until the time of the election, the safety and welfare of the Kenyan people. I agree with him entirely but again we made a Constitution in which we vested power in the Director of Public Prosecutions. We gave him security of tenure. We do not want to tell him how to do his job. I have no doubt that should he seek my counsel, I would be of the same view as the hon. Olago. Mr. Speaker, Sir, in response to the last comment by Mr. Shakeel, hon. Members in their wisdom set up a body which we gave authority to investigate, prosecute and to promote reconcilliation and mediation in appropriate cases. That body exercised that discretion in the specific context of the complaint that was before it. Without further information from this body, we cannot say that they exercised that discretion wrongly.
