  • 1 Oct 2019 in National Assembly: Hon. Speaker, my point of order is very brief. Thank you for the opportunity. I think we should realise we are dealing with a problem that should have been dealt with by the selection panel. It should never have come to the committee of the House. Issues of tax compliance should have been addressed there. Hon. Tiyah Galgalo, whom I have a lot of respect for, should have had the opportunity to rectify her documentation. So, the House should get a decision from the Speaker on how we shall deal with matters where an issue that should have been dealt ... view

Speaker, I, the undersigned, on behalf of the representatives of the Biodiversity and Biosafety Association of Kenya (BIBA-K), the Kenya Organic Agriculture Network (KOAN), Resources Oriented Development Initiative (RODI KENYA) and Route to Food Initiative (RTFI), draw the attention of this House to the following: THAT, there has been an increase in the prevalence of chemical pesticides in Kenya which pose a risk to human health and harmful effects to the environment; THAT, the volume of imported insecticides, herbicides and fungicides has more than doubled in the last four years from 6,400 tonnes in 2015 to 15,600 tonnes in ... view
  • 12 Sep 2019 in National Assembly: conditions is scarcely taken into consideration. The Pest Control Product Act Cap. 346 of the Laws of Kenya does not state environmental and/or human health as a possible concern during the registration process; THAT, the Kenya Plant Health Inspectorate Service (KEPHIS) has been contravening Section 15 of the Pest Control Product Act by failing to publish available information on the actual levels of pesticides in food samples collected and putting in place regular monitoring systems; THAT, there are no epidemiological health studies related to pesticide exposure on our health and their impact to the environment; THAT, the Pest Control Products ... view
  • 11 Sep 2019 in National Assembly: Thank you, Hon. Speaker. I ask the Chair of the Departmental Committee on Finance and National Planning to be more specific. Which date was the advertisement run in the daily newspapers and which day did you have the meetings and in which locations? I have been following it and I have not seen any whatsoever. view

  • 11 Sep 2019 in National Assembly: Treasury. They were tabled in this House on 2nd July. The Cabinet Secretary acted in exercise of powers conferred upon him under the Public Finance Management Act (No.18 of 2012), albeit wrongly because consultations on the matter were ongoing and it was therefore, in bad faith for the Cabinet Secretary for the National Treasury to rush to gazette the regulations while pre- publication scrutiny was actively before the Committee. The Cabinet Secretary stated that the purpose of the regulations relating to Biashara Fund, Youth Enterprise Development Fund, Uwezo Fund and the Women Enterprise Fund was to provide a one-stop shop ... view
  • 11 Sep 2019 in National Assembly: Statutory Instruments Act. On that basis, the Committee found that the regulations must be annulled because they were not subjected to public participation as required by Article 118 of the Constitution and Sections 5, 5(a), 13 (a) and (m) of the Statutory Instruments Act, which require that public participation and sufficient consultation with stakeholders and persons who are likely to be affected by the regulations must be done. In fact, today, several Members have explained that they continue to hold cheques in their offices, despite the merge, that belong to Uwezo Fund or the Youth Enterprise Development Fund or the ... view
  • 11 Sep 2019 in National Assembly: However, contrary to Section 16 of the Act, the National Treasury went ahead to publish the regulations and submitted them to Parliament without addressing the issues. In fact, the announcement of the regulations having been published came as a surprise on the day of the Budget Statement by the Cabinet Secretary for the National Treasury. Had we allowed these regulations to pass, we would have set a precedent where the Executive can negate the National Assembly’s oversight role. view
  • 11 Sep 2019 in National Assembly: Therefore, the Committee would like to let this House know that it has taken cognisance of the fact that there is a Bill that is entitled “The Kenya Uwezo Fund Bill, 2019 (National Assembly Bill No.42), which is currently before the National Assembly. It seeks to consolidate the same funds. At some point, the Committee was suspicious and assumed that, that was supposed to be a plan B should the Committee nullify the Biashara Kenya Fund Regulations. view
