Thank you, Hon. Deputy Speaker. I rise to second the Report of the Departmental Committee on Health. As the Vice Chair of the Committee has indicated, we went through the amendments that were proposed by the Senate and the areas that have been mentioned including the definition of “death”, the need for vaccination and maternity care to be given by both the national Government and county governments are important because, as it is now, vaccination is still to a large extent being organised by the national Government. Thank you, Hon. Temporary Deputy Speaker, for giving me an opportunity to contribute to this Bill. I stand to support it because in the first place, if you look at the parts of the law that it seeks to repeal then you see a clearer definition of the issues of contempt. This Bill seeks to protect people from arbitrary actions that lack clarity in the law. Indeed, this is a much more improved piece of legislation. people lack faith in the courts that would deliver justice. So, people take the law into their own hands. This law is, therefore, extremely important. In Clause 10, there is the issue of strict liability. It talks of publications that are adverse to justice. Given that it is broad, there are provisions that will protect those involved in the publication. One, they may not have been aware at the time that they were making the publication that there were proceedings in that nature. Thank you, Hon. Temporary Deputy Speaker. I rise to seek your guidance on the process that has brought this important Report in the House. The Report acknowledges how important it is that the Senate oversees county governments. I think that cannot be overstated and if clarification is made on what I want, I will probably discuss that much later. Thank you, Hon. Temporary Deputy Speaker. I just sought clarification. Now I am making my point. I come out to oppose this Report for a simple reason that I do not see the Committee as being sincere. On the first instance, they noted that legally, it was proper that it comes under the Parliamentary Service Act and they advised the Senate as such. The Senate goes ahead to act as advised, but again, they make a legal or technical error. They do not comply with the requirement. I do not see why the same Committee cannot sit with the Senate ...

Thank you, Hon. Temporary Deputy Speaker for giving me the opportunity to contribute to the County Assembly Services Bill. I support this Bill and marvel at how we have managed our devolution. Whereas I appreciate the work that the Senate has done, I do not understand how our county assemblies have worked without a proper legal framework and structure. I am happy that the Bill is here, but somehow sad that we had visitors listening to this. Constitution, which should have indicated to us the point that laws should have been in place for the county assemblies to operate. Not long ago, we passed the County Assembly Privileges Bill. It is surprising that county assemblies have worked for three years without any protection in terms of privileges. The Senate has done a good job to come up with this Bill that works on the legal framework and the structure.
