Thank you hon. Deputy Speaker, clearly the Speaker did issue out guidelines as to who is to respond to what type of Statements sought in this House. This Statement I am seeking fits squarely in the realm of the Statements that the Leader of the Majority Party is supposed to address. Firstly because the matters addressed here cross-cut various sectors and The electronic version of the Official Hansard Report is for information purposesonly. Secondly, this matter is of almost national importance because students have been expelled and suspended from the university on account of allegations that cannot be proved; on issues related to election rigging. Thirdly, this matter is urgent as I said earlier on; the university programmes are running and the students are at home.

On a point order, hon. Deputy Speaker. Earlier today, the Speaker gave us a leeway that later in the day we could raise some issues pertaining to this Bill that is before the House. Hon. Deputy Speaker, I rise under Standing Order 47 (3) (b). Without really reading it, that Standing Order basically talks about the Speaker’s discretion to determine which Motion should come before the House. My submission is that, that discretion is open-ended. It has to be exercised within the confines of constitutionalism, good governance and democratic principles. Hon. Deputy Speaker, really, I did not intend to interrupt the flow of the House programme but then I have got a little difficulty. If you look at the Order in question, which is Order No.10, about the Truth, Justice and Reconciliation (Amendment) Bill, if I may seek your indulgence for just two minutes, the Truth, Justice and Reconciliation Act was enacted sometime in the year 2008. the Truth, Justice and Reconciliation Commission was formed; which commission spent huge amounts of taxpayers’ money going around the country collecting views. The Commission finally did a report; which report found its way into the public domain. Therefore, the Amendment Bill that is being brought before the House has got the effect of trying to change the goal posts long after the TJRC report was published.
