Having laid the report, Hon. Speaker, allow me to give notice of the following Motion: THAT, this House adopts the Report of the Departmental Committee on Defence and Foreign Relations on its consideration of the multilateral convention on mutual administrative assistance on tax matters for ratification, laid on the Table of the House on Wednesday, 4th December 2019 and, pursuant to Section 8 of the Treaty-Making and Ratification Act, 2012, approves the ratification of the Convention on Mutual Administrative Assistance on Tax Matters. Thank you, Hon. Speaker. I rise to support this Motion. I do not want to repeat what my colleagues have said. The only thing I want to add relates to the work of the Departmental Committee on Defence and Foreign Relations, and more so the four ministries that we oversee – Defence, Foreign Affairs, East Africa Community and the National Intelligence Service (NIS). Hon. Speaker, I am not actually disputing what the Leader of the Majority Party is saying. I want to amend my earlier commitment of Thursday, next week because I have remembered that, the whole of next week, the Departmental Committee on Defence and Foreign Relations will be in Mombasa, with your permission,together with the Departmental Committee on Justice and Legal Affairs for a seminar up to 28th November, which will be Thursday, next week. So, please, allow me to respond on Thursday after next week. According to the House Calendar, that will be 5th December; we might be adjourning.

Thank you, Hon. Temporary Deputy Speaker. I had just started moving this Motion. Just to pick from where I left, I was saying that agreements are used to define the rights and obligations of militaries operating on foreign soil and the incorporation of the force or its members to the authority of the local officials.

The defence agreements that we have as a country include; the East African Co-operation Defence Protocol, the Western Indian Ocean Maritime Agreement and the Defence Agreement with Denmark. We also have a defence agreement with the United Kingdom. We have one which has been kept in abeyance awaiting adoption by this House. This is the so-called San Marco Agreement with the Italian Government. That is still awaiting adoption by the House.

The issue of co-operation and agreements draws its legal basis from Section 37 of the Kenya Defence Forces Act, 2012. It is about co-operation with other forces and forces visiting Kenya. There is also the issue of compensation of local communities in the event of accidents in areas where the military is deployed. Those are some of the things that must be defined in any treaty, agreement or co-operation. As a Committee, we analysed this. We are satisfied that they are clearly spelt out.
