Mr. Deputy Speaker, Sir, I rise to seek a Statement from the Minister for Justice, National Cohesion and Constitutional Affairs on the capacity or lack of capacity of the Chief Justice to issue a delegated legislation under Acts that fall under his jurisdiction. I asked him about a matter that is very critical now. Kenya is facing two by- elections in two Parliamentary constituencies and as of now, the Chief Justice has not acted in accordance with Section V of the Political Parties Act. Mr. Speaker, Sir, if you look at the number of times this Assistant Minister takes to answer questions relating to erection of road bumps and foot bridges, it is just amazing. Taking into consideration the fact that when roads are being constructed, it must be anticipated that the population in the market centres will increase, what is the policy of the Ministry in designing foot bridges and making them part of the road designs and not ad hoc solutions?

I am doing this because when I made an effort to get these details from the Ministry of Foreign Affairs, I was told that they only have half of the instruments and the other half is with the Attorney-General who told me the same thing. asked the Minister for Labour:- (a) whether he could confirm that when M/s Swan Industries Limited in Kisumu was placed under receivership, the Receiver entered into a written agreement with the Bakery, Confectionery, Food Manufacturing and Allied Workers Union, under which redundant workers would be paid all their dues on or before 30th June, 2009; (b) why the Receivers have not fully complied with all the terms of the agreement; and, (c) what action he will take to ensure that the Receivers honour the agreement and pay the former workers.

Mr. Speaker, Sir, it is true that the Assistant Minister has consulted with me, but the appointment of receivers for M/s Swan Industries Limited in Kisumu has got a lot of problems. So, I would request that the Assistant Minister does very thorough research and presents the report on Tuesday, next week, at 2.30 p.m.

Madam Temporary Deputy Speaker, I would like to thank the hon. Minister for a frank exposition of the issues that were raised. However, the final explanation that the matter arose because of confusion cannot be true because the two ranks of Telephone Operator and Telephone Supervisor are different. What is happening is that an officer in the Ministry is trying to effect promotions of staff without going through the scheme of service. To this extent, what action has the Ministry taken to ensure that this âconfusionâ does not happen again?
