  • 31 Jul 2014 in National Assembly: You find that because this Commission has too much time, they even comment on matters that are not their duty. For good reasons though, but that is not their duty. They even say that they are going to jail people who travel out of the country. That is not their duty. Even if MCAs went on foreign trips and it is within their Budget, we can only say that that is wastage of resources and we ask them to behave as leaders, but you cannot threaten elected leaders with taking them to jail yet you know very well that you ... view
  • 31 Jul 2014 in National Assembly: I agree with the amendment to the Political Parties Act because if you look at some of the amendments there, they are meant to remove the role of the Prime Minister, which is non-existent. We do not have a Prime Minister. Initially, for you to hire the Register of the Political Parties, you needed the concurrence of the Prime Minister. That is now not needed. I expected an amendment to help sort out the mess as hon. Gumbo put it, on this indiscipline in our political parties system. If you look at the Constitution on the setting up of the ... view
  • 31 Jul 2014 in National Assembly: The amendments to the Public Finance Management Act, I am happy that the Leader of Majority is saying that he will want to get those amendments removed. However, this leads me to ask a question which you asked the Leader of the Majority. When we get the Bills, are we sure that the office of the Leader of Majority Party has the capacity in terms of personnel and legal staff? view

  • 31 Jul 2014 in National Assembly: Hon. Temporary Deputy Speaker, you are right because I had this Bill and I did a lot of work on it, but I left my literature. I did not know this would come today. It is my fault, but from what I said, that is what this section is all about. The parent Act says that where Defence Forces are deployed for any purposes contemplated in sub- sections 1(b) and (c), I remember reading, it is deploying on emergency issues like the one that hon. Duale was referring to in Lamu and the other one is deploying them to maintain ... view
  • 30 Jul 2014 in National Assembly: On a point of order, hon. Speaker. I just wanted to get your guidance on this matter. This is because I believe the Motion before us, which has just been moved by the able Chair of the Departmental Committee on Justice and Legal Affairs, is based on the NCIC Act, 2008. I have difficulties whether we should proceed with this Motion without amending this Act. My argument is based on two reasons, the first one is with regard to Section 19 of the Act, which states that the Chairperson and the Commissioners shall hold office for a term of three ... view
  • 30 Jul 2014 in National Assembly: Thank you for that, hon. Speaker. Maybe, we still require one more year for some hon. Members to learn these rules. I rose on a point of order to seek guidance from the Chair with regard to whether we should proceed with this Motion without amending the Act that puts this Commission in place. The National Cohesion and Integration Commission Act, 2008 has certain provisions and I want to restrict myself to just two areas. The first one, which I have just read out, is Section 19, which provides for the term of office for the commissioners, both the chairperson ... view
  • 30 Jul 2014 in National Assembly: positions in accordance with the amended law. This is because right now I am at a loss under which law we are filling the vacancies – we are even allowed as Parliament to interview, recruit, approve and send nominees to the President. Hon. Speaker, I am in a dilemma on this. Even though I have no major issues with some of the names here - except some names of course - I would have problems because this is not cohesion really. We are bringing in party chiefs like the Chair of URP who will, possibly, chair the Commission; this will ... view
  • 30 Jul 2014 in National Assembly: Hon. Speaker, what the Chairman has said is exactly what I said. I am aware that this Act still continues even after the promulgation of the Constitution in 2010; this Act was passed in 2008 and that is why I am quoting from it. However, my concern is this: Even if the terms of the commissioners lapsed and they are no longer in office, we need to make appointments to the Commission following the provisions of the Act. The Chairman has not clearly pointed out to me under which section of this Act this recruitment, or appointment, is being made. ... view
