Thank you, Mr. Deputy Speaker, Sir. In the 2010/2011 Financial Year, each Constituency was allocated about Kshs27 million under the 22 per cent portion. This year that has just ended, 2011/2012, each constituency got about Kshs19 plus million. That is a reduction of about Kshs8 million per constituency. On a point of order, Mr. Deputy Speaker, Sir. This is a very serious matter. It is not normal to have collections from fuel levy reducing constituency allocation from Kshs27 million to Kshs20 million in one single year. Given the fact that we have issues with collection of revenue in this country, I think it is in order if we could allow what hon. Lessonet had suggested, that this matter be referred to the relevant Committee to investigate since the user Ministry has not taken the initiative to find out why there has been such a serious and drastic drop. ...

Mr. Speaker, Sir, from the Assistant Minister’s answer, he is saying that after the works, the rains then destroyed the road. What was the time lag between the time that the contract work was completed and the time that the rains came? That is because Ministry officials use rain as an excuse, when actually contractors do not do their work.

Mr. Speaker, Sir, as hon. Odhiambo-Mabona has just said, actually, that Shivling Supermarket is just 200 metres away from the police station. There have been so many reported cases of this nature in Homa Bay. What is the Minister doing to reshuffle the police officers who are in Homa Bay, so that we can get more serious police officers to patrol that town so that the locals do not suffer from those unnecessary massacres?

Mr. Speaker, Sir, a number of times the Government has information that the rest of us do not have. Therefore, those who are politically correct use this information to go and acquire land in areas where there are likely to be discoveries. I think this Committee needs to look at who owns land in these regions. If you are coming from another part of the country you need to tell us when you acquired this land. On a point of order, Mr. Chairman, Sir. Is it in order for Mr. Keter to mislead this House that if he associates himself with ODM in his constituency he cannot be elected, yet we know he is a member of ODM in the House and has never resigned to be a member of URP? He should resign and win his seat again to prove his case. Is it in order to rely on hypothesis rather than reality?

Mr. Deputy Speaker, Sir, the Budget Estimates were tabled on the 26th of April, 2012. The Budget Committee did a good job and brought their Report to this House. On the 6th of June, that Report was adopted by the House. The Government had all the time to follow all the provisions of the Constitution. Unfortunately, the Government decided to act with impunity to ignore to bring the relevant legislations that are required before the Vote on Account is prepared. One would have expected that from 6th to date, the Minister would have engaged with the Budget Committee or Parliament ...

Mr. Deputy Speaker, Sir, I am exactly giving reasons why I am opposing unless the House does not want to listen to me. I am opposing this because the judge has already pronounced himself to this particular matter before us. As someone who is a law abiding citizen, I cannot support this Motion knowing very well that it is violating the provisions of the Constitution.
