  • 21 Jun 2012 in National Assembly: Mr. Deputy Speaker, Sir, before you invite Mr. Mutula Kilonzo, what I am saying I am reading from the Constitution unless you are telling us that Kenyans passed a wrong Constitution. It says:- “If the Appropriations Act for a financial year has not been assented to---“ This is the Constitution. Mr. Deputy Speaker, Sir, whether it s wrong, you live with the Constitution. This is the Constitution. view
  • 21 Jun 2012 in National Assembly: Mr. Deputy Speaker, Sir, thank you for your guidance but I believe that if there is a provision in the Constitution that sounds vague or cannot be understood, it is for the courts to interpret. The moment the courts have interpreted, we cannot again say that the interpretation of the court is wrong and that is where I have a problem because the courts have told us that there should have been an Appropriation Bill in place. view
  • 21 Jun 2012 in National Assembly: But there was no appeal! The Attorney-General lost the case and did not appeal. If this Government knew that the judge was wrong, what the Attorney- General would have done was to appeal. There is no appeal, which means that the Government accepted that they lost the case fairly and squarely. view
  • 21 Jun 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. Is it in order for the Minister to mislead this House by implying that any time we have a new Minister, we have to violate the Constitution? What if we will be having a new Cabinet Secretary for Finance every year? view
  • 21 Jun 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. Is it in order for the Minister to mislead us that the Minister, having been engaged in some activities like meetings, is the reason we could not have these documents in good time, yet we know that the Minister is just a policy maker in the Ministry and he is not the one dealing with view
  • 21 Jun 2012 in National Assembly: On a point of information, Mr. Deputy Speaker, Sir. view
  • 21 Jun 2012 in National Assembly: Mr. Deputy Speaker, Sir, I am happy that we have reversed some of the mistakes that we were likely to make. Surprisingly, the most important one has come from none other than Mr. Kimunya. I did not expect that but I thank God he has done what he did. view
  • 21 Jun 2012 in National Assembly: On a point of order, Mr. Deputy Speaker, Sir. I think we need to respect procedures and rules of the House. We sat as a Budget Committee which hon. Sambu is the Vice-Chairman and we agreed that this is unconstitutional and we will not accept it. That was the Budget Committee’s position. We have to respect it. view
  • 21 Jun 2012 in National Assembly: Mr. Temporary Deputy Chairman, Sir, I would also like to support my colleagues that this Bill, I think we need a little more time, especially, to look at the amendments that the Minister has proposed. I would even like to tell this House that I have seen one of the amendments in this Bill proposing to legalise the illegality which the Treasury has been perpetuating, and which the Speaker is supposed to rule on I believe this afternoon. So, if we allow the Committee Stage of this Bill to proceed, we may live to regret it later. view
  • 21 Jun 2012 in National Assembly: Mr. Deputy Speaker, Sir, is it in order for the Minister, whom I respect, having helped me when I had disasters in my constituency, to imply that by saying that we should follow the Constitution and pass the Vote on Account next week, we are refusing to release money to her Ministry? We want to give her the money procedurally and properly, on the dictates of the Constitution. Is that a threat not to give me money in future? view
